Núcleo de prática jurídica e efetivação do direito de acesso à justiça : análise de sua contribuição para a população de Goiatuba-GO

Abstract

Resumo: Este estudo tem o objetivo de analisar a contribuição do Núcleo de Prática Jurídica de uma instituição de ensino superior pública municipal em Goiatuba-GO como instrumento que viabiliza o exercício da cidadania, no que se refere ao acesso à justiça da população economicamente vulnerável. A partir da premissa de disponibilização de um serviço público à sociedade, pretende-se levantar dados que caracterizem o atendimento jurídico prestado pelo Núcleo de Prática Jurídica e que possibilitarão identificar sua contribuição ao acesso à justiça como direito fundamental do cidadão, e por conseguinte, como gerador de desenvolvimento humano. Para tanto, esta pesquisa é exploratória, documental e de campo, com abordagem quantitativa e qualitativa. Foram utilizados dois instrumentos: formulário fechado para apuração da realidade social de cada indivíduo atendido e entrevistas semiestruturadas a representantes dos três sujeitos sociais inseridos nesta relação: a população atendida (ou potencialmente atendível), os estudantes do curso de Direito da FESG/FAFICH que realizam o atendimento ao público e o coordenador(a) do Núcleo de Prática Jurídica, representando a visão institucional. Foram também analisados os seguintes documentos institucionais: Portaria de Reconhecimento do Curso de Direito da FESG/FAFICH nº 761 de 23 de abril de 2010, Regulamento do Núcleo de Prática Jurídica e fichas cadastrais de pessoa assistida pelo Núcleo de Prática Jurídica. Os resultados revelaram satisfação das pessoas atendidas em relação ao Núcleo de Prática Jurídica, com reconhecimento de contribuição positiva para a comunidade goiatubense e para o empoderamento e engrandecimento individual, tornando-as aptas a exercer a cidadania e mais conhecedoras de seus direitos. Pôde-se concluir que o objetivo estipulado pelo Núcleo de Prática Jurídica da FESG/FAFICH cumpriu com seu papel social, representando marco significativo para facilitação do acesso à justiça para as pessoas de baixa renda e com pouco conhecimento jurídico, gerando desenvolvimento humano para as pessoas envolvidas.

Abstract: This study aims to analyze the contribution of the Legal Practice Center of FESG/FAFICH (a college education in Goiatuba-GO), as an instrument that makes possible the exercise of citizenship, offering access to justice for the economically vulnerable population. Based on the premise of making a public service available to society, it is intended to collect data that characterize the legal assistance provided by the Legal Practice Center and that will enable it to identify its contribution to access to justice as a fundamental right of the citizen, and therefore, as a generator of human development. Therefore, this research will be exploratory, documental and field, with a quantitative and qualitative approach. Two instruments will be used: a closed form for ascertaining the social reality of each individual attended and semi-structured interviews with representatives of the three social subjects included in this relation: the population served (or potentially served), FESG/FAFICH law students performing the attendance to the public and the coordinator of the Legal Practice Center, representing the institutional vision. The following institutional documents will also be analyzed: FESG/FAFICH Law Course Recognition No. 761 of April 23, 2010, Regulation of the Legal Practice Center and registration forms for persons assisted by the Legal Practice Center. The results revealed satisfaction of the people served in relation to the Legal Practice Center, with a positive contribution to the Goiatuba community and to the empowerment and individual aggrandizement, and it became them capable to exercise citizenship and more knowledge about their rights. It concluded that the objective stipulated by the FESG / FAFICH Legal Practices Center fulfills its social role, and represent a significant framework for facilitating access to justice for low income people with little legal knowledge, generating human development for the people involved.
