Poluição por disposição inadequada de resíduos sólidos pela pessoa jurídica de direito privado e sua responsabilidade penal nos termos da Lei 9.605/98 : lei de crimes ambientais

Abstract

Resumo: O presente trabalho teve a finalidade de avaliar a eficácia da responsabilização penal das pessoas jurídicas de direito privado quando do cometimento de crime de lançamento de resíduos sólidos, bem como os efeitos causados ao meio ambiente, e o levantamento das devidas penas a serem aplicadas. Ainda, no presente trabalho foi feito o levantamento de técnicas de tratamento para os resíduos sólidos, buscando desta forma o menor grau de poluição e contaminação do meio ambiente, e a preservação da saúde dos seres humanos. A responsabilização da pessoa jurídica na área penal é um tema polêmico e inovador, tendo em vista que quando se falava em responsabilização da pessoa jurídica por prática de crime ambiental, as penas aplicadas eram no âmbito civil e administrativo, com aplicação de multas e não com pena privativa de liberdade para os sócios-proprietários, ainda mais se o crime fosse praticado por funcionário. Porém, com a necessidade da preservação do meio ambiente, como bem essencial para a qualidade de vida dos seres humanos, e para se evitar a degradação sem limites, os juízes reformularam sua maneira de entender o assunto e passaram a julgar, impondo a responsabilidade penal para a pessoa jurídica, sendo tal posicionamento e entendimento recente. Atualmente, o crime mais praticado pelas pessoas jurídicas de Maneira indiscriminada e sem limites é o de poluição por lançamento de resíduos sólidos, casos em quese não houver uma rigorosa punição pela prática de tais crimes e imposição de penas rigorosas aos agentes infratores, mesmo na qualidade de pessoa jurídica, os danos causados ao meio ambiente podem ser catastróficos, e muitas vezes irreversíveis. Sendo assim, a presente pesquisa visou atingir às pessoas estudiosas da área do Direito, Direito Ambiental e Ciências Ambientais, de uma maneira informativa e consciente e demonstra a possibilidade da responsabilização penal da pessoa jurídica de direito privado ao cometer crime de poluição por lançamento de resíduos sólidos.

Abstract: The present work had the purpose to evaluate the effectiveness of the criminal responsibility of legal people when of the commitment of crime of launching of solid residues, as well as the effect caused to the environment, and the survey of the had penalties to be applied. The present work the survey of techniques of treatment for the residues was made, searching of this form the least degree of pollution nancontamination of the environment, and the preservation of the health of the human beings. The responsibility of the legal entity in the criminal area is an controversial subject and innovator, in view of that when if spokein responsibility of the legal entity for practical of crime ambient, the applied penalties were in the civil scope and administrative, with application of fines and not with privatize penalty of free domforthe partner-proprietors, still more if the crime it was practiced by worker. With the necessity of the preservation of the environment, as well essential for the quality of life of the human beings, and to prevent the degradation without limits, the judges they had reformulated their way to understand the subject and had started to judge, imposing the criminal liability for the legal entity, being such positioning and agreement recent. Nowadays the crime most commited by the legal people in indiscriminate way and without limits it is of pollution for launching of solid residues, cases where if there isnorigorouspunishment for practical of such crimes andimpositionof rigorous penalties to the agent inflators, exactly in the quality oflegal entity, the actual damages to the environment can be catastrophic and irreversible. The present research aimed atto reach the studious people of the area of the Right, Environmental law and Ambient Sciences, in an informative and conscientious way and demonstrate to the possibility of the criminal responsibility of the legal entity when committing crime of pollution for launching of residues solids.
