O abandono decorrente da ruptura familiar e seus reflexos morais e materiais

Abstract

Resumo: O objetivo do estudo abandono decorrente do rompimento familiar e seus reflexos morais e materiais com a consequência do tendo como principal prejudicado, os filhos menores, é a reflexão das dificuldades que a criança e o adolescente lidam com essa situação, analisando também as decisões judiciais no que tange o cabimento de indenização, além de trazer a responsabilização do Estado e da família. Neste sentido, o estudo aborda a origem e evolução da família, o poder de família, sua ruptura e consequências, os efeitos psicológicos e sociológicos e a aplicabilidades legais da lei, com entendimentos jurisprudenciais sobre o abandono afetivo. Assim, com o estudo, conclui-se que, com o rompimento familiar, o abandono afetivo torna-se uma consequência devastadora se os familiares e o Estado nada fizerem para evitar os resultados negativos. Assim, para uma segurança jurídica há respaldo legal na condenação pelo abandono afetivo, como uma forma de amenizar todo esse dano sofrido.

Abstract: The objective of the abandonment study resulting from family breakdown and its moral and material reflexes with the consequence of having as its main disadvantage, the minor children, is the reflection of the difficulties that the child and adolescent deal with this situation, also analyzing the judicial decisions in the regarding the adequacy of indemnity, besides bringing the responsibility of the State and the family. In this sense, the study addresses the origin and evolution of the family, family power, its rupture and consequences, the psychological and sociological effects and the legal applicability of the law, with jurisprudential understandings about affective abandonment. Thus, the study concludes that with family breakup, emotional abandonment becomes a devastating consequence if family members and the state do nothing to avoid negative outcomes. Thus, for legal certainty there is legal support in condemning the emotional abandonment, as a way to mitigate all this damage suffered.
