Alienação parental : a importância dos aspectos legais e processuais

Abstract

Resumo: O presente trabalho aborda o tema alienação parental e as medidas tomadas pelo judiciário decorrente da evolução histórica do conceito família. Veremos também a pratica dos pais que tentam dificultar a convivência do filho com o genitor que não possui a guarda, interferindo grandemente na vida social e educação do filho. Verifica-se as formas de como a lei pode intervir na vida familiar após a separação do casal que na maioria das vezes tem atitudes impróprias para com os filhos. Este estudo baseou-se em pesquisas bibliográficas, doutrinas, tendo como esboço a Lei taxativa. Por fim, para concluir os estudos, fora feito um entendimento das características da alienação parental e de seus alienantes, a atuação da família e da Justiça Brasileira na busca de soluções para tal questão que causa danos tão severos aos filhos que não podem se defender, nem tampouco entender o que de fato está acontecendo.

Abstract: This paper addresses the issue of parental alienation and the measures taken by the judiciary arising from the historical evolution of the concept of family. See also the practice of parents who try to make it difficult for their children to live with the parent who has no custody, greatly interfering with their child's social life and education. It appears as the forms of law that can interfere in family life after the selection of the couple who most often have harmful attitudes to their children. This study was based on bibliographical research, doctrines, having as outline the Taxative Law. Finally, to conclude the studies, for an understanding of the characteristics of parental alienation and its alienators, an action of the family and the Brazilian Justice in the search for solutions to issues that cause damages as serious as the children who cannot defend themselves, nor neither understand what is happening.
