A alienação parental : aspectos jurídicos e psicossociais

Abstract

Resumo: A Alienação Parental trata-se de interferência na formação psicológica do menor, seja criança ou adolescente, por influência direta ou indireta de um de seus genitores ou do detentor da guarda, visando prejudicar o vínculo afetivo entre as partes. Tal conduta passou a ser tratada pela legislação brasileira no ano de 2010, com a promulgação da Lei n° 12.318/2010. Lei esta que nos traz seu conceito, as formas de alienação (em um rol meramente exemplificativo), suas possíveis consequências e os envolvidos, sendo alienador quem pratica os atos e o alienado que é o genitor que sofre os atos praticados, o alienado é tão vítima quanto o menor que sofre diretamente as agressões. Como veremos, tal prática passa a ocorrer com a ruptura de uma relação amorosa entre duas pessoas, neste caso, os genitores, onde uma das partes não consegue aceitar o fim de forma madura e usa a prole para atacar o ex-cônjuge ou companheiro. Apesar do gatilho inicial normalmente ser o fim de um relacionamento, não necessariamente o alienador é um dos genitores, pois, pode ser avós que lidam com o menor, tutores, entre outras figuras. Pode-se observar que se trata de uma prática que afeta diretamente o genitor alienado, mas também o menor, causando danos de difícil reparação de cunho psicológico e social ocasionando na maioria das vezes a denominada Síndrome da Alienação Parental (SAP), que se trata de uma espécie lavagem cerebral realizada no menor por meio de ataques psicológicos, com a finalidade de afastá-lo do genitor alienado. Como a Alienação Parental é um tema que ocorre principalmente pela alteração das famílias e suas rupturas é importante tratar de todo processo de evolução, desde o Código Civil de 1916 até o presente momento, trazendo o contexto atual de Família baseada no afeto.

Abstract: The Parental Alienation is interference in the psychological formation of the minor, whether child or adolescent, by direct or indirect influence of one of its parents or the holder of custody, aiming to harm the affective bond between the parties. Such conduct began to be addressed by Brazilian legislation in 2010, with the enactment of Law No. 12.318/2010. This law brings us its concept, the forms of alienation (in a merely exemplary role), its possible consequences and those involved, being alienator who performs the acts and the alienated who is the parent who suffers the acts performed, the alienated is as victim as the minor who suffers directly from the aggressions. As we will see, this practice starts to occur with the rupture of a loving relationship between two people, in this case, the parents, where one of the parties can not accept the end in a mature way and uses the offspring to attack the former spouse or partner. Although the initial trigger is usually the end of a relationship, not necessarily the alienator is one of the parents, because it can be grandparents who deal with the minor, tutors, among other figures. It can be observed that this is a practice that directly affects the alienated parent, but also the minor, causing damage that is difficult to repair psychologically and socially, most of the time causing the so-called Parental Alienation Syndrome (SAP), which is a kind of brainwashing performed on the minor by means of psychological attacks, with the purpose of keeping him away from the alienated parent. As Parental Alienation is a theme that occurs mainly due to the alteration of families and their ruptures, it is important to deal with the entire process of evolution, from the Civil Code of 1916 to the present moment, bringing the current context of Family based on affection.
