Deficiência mental e a capacidade civil : avanço ou retrocesso?

Abstract

Resumo: Este trabalho tem o objetivo de analisar, à luz do Direito brasileiro, a capacidade civil das pessoas com deficiência mental. Serão analisados neste trabalho os itens mais relevantes do conhecido Estatuto da Pessoa com Deficiência, que foi promulgado no ano de 2015, e seguia os preceitos anteriormente citados na Convenção sobre os Direitos das Pessoas com Deficiência. Assim, torna-se importante a análise sobre as mudanças que o Estatuto da Pessoa com Deficiência trouxe ao Direito Civil, mais especificamente aos termos inerentes ao casamento e interdição dos cidadãos civis brasileiros, da mesma forma que também foram percebidas mudanças relevantes nos conceitos sobre prescrição e decadência, que não podem ter o mesmo entendimento para os cidadãos comuns e os reconhecidos como incapazes.

Abstract: This paper aims to analyze, in the light of Brazilian law, the civil capacity of people with mental disabilities. This paper will analyze the most relevant items of the well-known Disability Statute, which was promulgated in 2015, and followed the precepts previously cited in the Convention on the Rights of Persons with Disabilities. Thus, it is important to analyze the changes that the Statute of Persons with Disabilities has brought to Civil Law, more specifically to the terms inherent in the marriage and interdiction of Brazilian civil citizens, as well as also relevant changes in the concepts of prescription. and decay, which cannot have the same understanding for ordinary citizens and those recognized as incapable.
