Delação premiada

Abstract

Resumo: O presente trabalho de Graduação Acadêmica, versa sobre o instituto da Delação Premiada, o qual respeitando suas terminologias adotadas pelos doutrinadores, em um instituto de cunho negocial e punitivo, pois aquele que delata de forma espontânea e voluntaria seus comparsas e a organização criminosa que faz parte, colabora para alcançar resultados satisfatórios nas investigações e recebem em troca o benefício como a redução da pena privativa de liberdade e até me raros casos o perdão judicial. É relevante salientar que a delação premiada em nosso ordenamento segue o modelo estadunidense, nomeado de ple bargaining. Por apresentar um tema com uma estrutura ampla, não busca esgotar o tem, mas sim, sua evolução histórica até os moldes que é utilizado hoje, abordar seus procedimento e aspectos gerais, questões controvertidas, alude várias leis onde se faz presente e além dos diversos princípios constitucionais usados dentro do tema. Por fim, aponta uma análise psicológica do instituto, demostrando como se da conduta humana durante e após a delação, apontando várias correntes, mas principalmente a corrente comportamental "behaviorista".

Abstract: The present work of Academic Graduation, deals with the Institute of the Awarded Delegation, which respecting its terminologies adopted by the indoctrinators, in an institute of negotiation and punitive nature, because the one that spontaneously and voluntarily reports its colleagues and the criminal organization that makes In part, it collaborates to achieve satisfactory results in the investigations and receives in return the benefit such as the reduction of the custodial sentence and even in rare cases the judicial pardon. Because it presents a theme with a broad structure, it does not seek to exhaust its history, but rather its historical evolution to the molds that are used today, addressing its procedure and general aspects, controversial issues, alludes to various laws where it is present and beyond the various constitutional principles used within the theme. Finally, it points out a psychological analysis of the institute, demonstrating as if the human conduct during and after the denunciation, pointing out several currents, but mainly the "behaviorist" behavioral current.
