Excludentes de ilicitude

Abstract

Resumo: O presente trabalho aborda as causas excludentes de ilicitude no âmbito do Direito Penal, trazendo suas formas de funcionamento no ordenamento jurídico brasileiro. Em seu primeiro capítulo traz um breve conceito e as noções do referido direito penal, conseguinte, no segundo capítulo mais aprofundado no tema do presente trabalho aborda-se o conceito de ilicitude, e suas excludentes, bem como a importância de cada uma delas. Outrossim, sem delongas, deu-se o desenvolvimento das excludentes, sendo elas: Estado de Necessidade, A Legitima Defesa, O Estrito Cumprimento do Dever Legal e o Exercício Regular de Direito. Por fim, conclui-se que cada uma dessas excludentes tem sua importância no ordenamento jurídico.

Abstract: The present work approaches the excluding causes of conduct illicit in the scope of Criminal Law, bringing its forms of operation in the Brazilian legal system. In its first chapter it brings a brief concept and the notions of the referred criminal law,consequently, in the second chapter more in depth in the subject of the present work deals with the concept of conduct illicit, and its excluding, as well as the importance of each one of them. Moreover, without delay, the development of the excluding, being them: State of Need, Self-Defense, Strict Compliance with Legal Duty and Regular Exercise of Law. Finally, it is concluded that each of these excluders has its importance in the legal system.
