Feminicídio : uma abordagem estatística

Abstract

Resumo: O presente trabalho voltado especialmente para as mulheres vislumbra o estudo minucioso da Lei 13.104/2015, denominada de Lei do Feminicídio, que altera o artigo 121 do Código Penal Brasileiro, a conceituação da mesma, abrangendo o contexto histórico e diretrizes até que o mesmo fosse incorporado em nosso ordenamento jurídico e a forma como é aplicado. Expõe dados sobre a violência que há contra as mulheres no cenário brasileiro, a fim de demonstrar que a presença desse crime ainda é, infelizmente, fortíssimo no Brasil, e que há a necessidade de se criar políticas públicas e fazer campanhas de prevenção, para trazer visibilidade, com a finalidade de evitar mais mulheres com o final trágico de feminicídio. A Lei 13.104 de 2015 tem por objetivo punir mais severamente aquele que atenta contra a vida da mulher, com o advento dessa lei o assassinato de uma mulher por razões de sexo feminino que envolve violência doméstica e familiar ou discriminação e menosprezo a condição de mulher. A lei altera o código penal passando a ser homicídio qualificado, incluso também no rol taxativo de crimes hediondos. O Estado deve garantir a dignidade da pessoa humana, a Lei do feminicídio é uma ferramenta para a garantia da dignidade da mulher, que tem o direito de viver tranquilamente sem o domínio do homem que a enxerga como um objeto de sua posse. Com a penalização mais severa a lei penal tem como objetivo reduzir a violência e o assassinato contra mulheres, garantindo a elas maior proteção e não deixando impune aquele que pratica tal conduta, resguardando o bem mais precioso a ser tutelado que é a vida. O estudo deu-se por meio da leitura de livros, artigos, relatórios, reportagens, dossiês, coleta de dados em Delegacia e documentos legais relacionados ao tema.

Abstract: The present work focused especially on women, glimpses the study of the Law 13.104/2015, called as Feminicide Law, that changes the article 121 from Brazilian Penal Code, it conceptions, reaches the historical and limited context even incorporated in our order and how it is applied. It shows data about violence against women in the Brazilian scenario, and showing that the presence of this crime, is unfortunately, big in Brazil, and that has the necessity of creating public policies and of doing campaigns for preventing this kind of crime, so then bringing visibility in Brazil, with the intention of avoiding tragically feminicide ends for women. The Law 13.104/2015 has harder punishment for the feminicide murderer as main objective, with this law the killer is the person that kills woman because of female reasons involving domestic and family violence or discrimination and disregard as a woman. The law amends the penal code by passing a qualified murder, including also no tax on heinous crimes. The Brazilian State must guarantee the dignity of the human person; the feminicide law is a tool to guarantee the dignity of women, who have the right to live peacefully without the domination of the man who sees her as an object of their possession. With harsher penalty, the purpose of criminal law is to reduce violence and murder against women, to apply the greatest protection for them, and also, giving the person who practice feminicide the correct punishment, safeguarding life, the most important thing that exists. This study was made through reading books, articles, reports, dossiers, data collection in police stations and legal documents related to the subject.
