Pirâmides financeiras e o crime de economia popular

Abstract

Resumo: O presente trabalho tem como iniciativa mostrar e aprimorar o conhecimento sobre pirâmides financeiras, primeiramente aborda o que são as pirâmides e como elas funcionam, já que é um tema bem antigo porem não há uma severa explicação sobre isso, tendo em vista que a sociedade tem pouco conhecimento sobre a ilicitude das pirâmides financeiras porem ainda sim caem no antigo "golpe". Falarei também sobre as diferenças entre os esquemas de Esquema de Ponzi e Marketing Multinível, não importa o nome dado aos esquemas, mas sim a sua estrutura, sendo ela corrente ou doação. Consequentemente os crimes financeiros por trás dessas organizações fraudulentas com base no Código Civil e no Código de Defesa do Consumidor, o qual é aplicado os danos matérias e morais advindos da fraude. Outrossim, será feita uma análise sobre a responsabilidade civil e penal nas Pirâmides, além de explanar sobre os casos concretos e seus objetivos ocorridos no Brasil e como o nosso Código Penal ainda se mostra bem ineficaz com relação ao combate das pirâmides financeiras.

Abstract: The present work has as its initiative to show and improve the knowledge about financial pyramids, first discusses what the pyramids are and how they work, since it is a very old theme because there is no detailed explanation about it, considering that society has little knowledge of the illegality of the financial pyramids still fall into the old "coup". I will also talk about the differences between the Ponzi and Multilevel Marketing schemes, no matter the name given to the schemes, but rather its structure, being it current or donation. Consequently, the financial crimes behind these fraudulent organizations based on the Civil Code and the Consumer Protection Code, which the material and moral damages arising from the fraud are applied. Futhermore, an analysis will be made of civil and criminal liability in the Pyramids, in addition to explaining specifc cases and their related objectives in Brazil and how our Penal Code still proves to be very ineffective with regard to the combat of the financial pyramids.
