Refúgio : a proteção internacional da pessoa humana na atualidade

Abstract

Resumo: O presente Trabalho de Graduação analisa o refúgio como instituto de proteção à vida humana. Diante da intenção de demonstrar quais são as características atuais dos refugiados e a essência atribuída ao mecanismo jurídico. A abordagem delineia os aspectos gerais do refúgio e dos sujeitos protagonistas, com base na exposição de dados relativos ao refúgio no cenário mundial. O tema adquiriu relevância jurídica e política especialmente por envolver a responsabilidade internacional dos Estados. Foi realizada nesta pesquisa uma reflexão histórica a respeito da construção dos mecanismos envoltos ao direito dos refugiados, em muitos casos, no transcorrer dos anos, nota-se que o progresso ocorreu em sintonia com o fortalecimento e a universalização dos direitos humanos. Ao longo deste trabalho um capítulo é dedicado ao estudo dos Direitos Humanos abordando sua construção, fundamentação teórica que lhe proporciona estrutura e seus mecanismos de efetivação. O método utilizado na elaboração textual deste trabalho foi o crítico-histórico, com a realização de revisão bibliográfica com base na consulta das diversas fontes de pesquisa disponíveis. Como as doutrinas de direito internacional, direito constitucional e direitos humanos, obras de natureza histórica e antropológica que dão o tom de interdisciplinaridade, também foram consultadas normas constitucionais e infraconstitucionais, textos de Tratados, Convenções e Declarações Internacionais, artigos científicos e dados disponibilizados online pelas plataformas da Organização das Nações Unidas e do Alto Comissariado das Nações Unidas para Refugiados. Com a finalidade de observar aquilo que pode ser considerado como o instituto jurídico mais relevante dentro dos mecanismos internacionais de proteção aos direitos humanos.

Abstract: This undergraduate work examines refuge as an institute for the protection of human life. Given the intention to demonstrate what are the current characteristics of refugees and the essence attributed to the legal mechanism. The approach outlines the general aspects of the refuge and the protagonists, based on the exposure of refuge data on the world stage. A historical reflection on the construction of the mechanisms involved in refugee law was carried out in this research. In many cases over the years it has been noted that progress has been made in line with the strengthening and universalization of human rights. Throughout this work a chapter is devoted to the study of Human Rights addressing its construction, theoretical foundation that provides structure and its mechanisms of implementation. The method used in the textual elaboration of this work was the historical-critical, with a bibliographic review based on the consultation of the various available research sources. Like the doctrines of international law, constitutional law and human rights, works of historical and anthropological nature that give the tone of interdisciplinarity, were also consulted constitutional and infraconstitutional norms, texts of Treaties, International Conventions and Declarations, scientific articles and data available online by platforms of the United Nations and the United Nations High Commissioner for Refugees. In order to observe what can currently be considered as the most relevant legal institute within international human rights protection mechanisms.
