Abstract

Resumo: O presente estudo tem como principal ideia transmitir o que é a poluição sonora e como ela é maléfica a saúde, bem como os meios de responsabilizar por meio de indenização quem a produz. Primeiramente é necessário compreender o que é a poluição sonora, sendo ela um meio de poluição desconhecida até os dias atuais por muita gente, porque não há muita divulgação sobre ao assunto. Contudo, ela é uma das poluições mais perigosas ao meio ambiente, porque ela está em toda parte, ela é simplesmente produzida por sons que chegam acima do acima do aceitável pela NBR 10151 e 10152, e a partir disso trazem problemas a saúde do homem e para animas. Entretanto, existe a em nosso ordenamento jurídico a responsabilidade civil ambiental que tem a finalidade de fazer o agente poluidor se responsabilizar por atitudes e um desses meios de responsabilização é por meio de indenização, principalmente por danos morais, no caso da poluição sonora, para aquelas pessoas que acabam tendo suas saúdes prejudicadas por conta de ruídos, que estão acima do permitido em lei. Portanto, o estudo deste tema é de grande importância, mas é um assunto que acaba não sendo muito tratado pela mídia. Então, por meio de jurisprudências, doutrinas e legislações é buscado trazer mais conhecimento, para que assim as gerações dos presentes e a do futuro possam ter uma qualidade de vida cada vez melhor.

Abstract: The present study has as its main idea to convey what noise pollution is and how harmful it is to health, as well as the means of making responsible for indemnity who produces it. Firstly, it is necessary to understand what noise pollution is, and it is a means of pollution unknown to the present day by many people, because there is not much disclosure on the subject. However, it is one of the most dangerous pollution to the environment, it is everywhere, it’s simply produced by sounds that reach above the acceptable levels of NBR 10151 and 10152, and from there bring problems to the health of man and woman. for animals. However, in our legal system there is envi-ronmental liability that has the purpose of making the polluting agent responsible for attitudes and one of these means of liability is through compensation, especially for moral damages, in the case of noise pollution, for those people who end up with their noise-damaging health, which is above the law. Therefore, the study of this subject is of great importance, but it is a subject that ends up not being much treated by the media. So, through jurisprudence, doctrines and legislation, it is sought to bring more knowledge, so the current and future generations can have an ever better quality of life.
