A importância da justiça terapêutica em crimes com menor potencial ofensivo

Abstract

Resumo: A aplicação da Justiça Terapêutica na recuperação do usuário e dependente químico visa resguardar a este, seus direitos fundamentais garantidos pela Constituição Federal, referindo-se aos direitos humanos, no artigo 4º inc. II e aos direitos e garantias individuas, no artigo 5º parag. 1ª do mesmo diploma. Observando que a Organização Mundial de Saúde já reconheceu a dependência química é uma doença, o emprego do programa aqui defendido encontra subsidio no artigo 196 da Constituição Federal, que reconhece que a saúde é um direito de todos e um dever do Estado. Foi utilizado, nesse trabalho, a observação indireta, através de materiais bibliográficos, pesquisa de campo diretamente com Promotor da Comarca de São Jose dos Campos Dr. Fabio Rodrigues Franco Lima , constatando que a terapia aplicada conjuntamente com a justiça criminal, que decorre do uso de drogas, é bastante satisfatória, pois mantem o caráter punitivo, com tratamento de saúde, e ao mesmo tempo promove através das reuniões, reflexões comportamentais, para análise das práticas maléficas que causaram tanto a sociedade como a si mesmo.

Abstract: The application of therapeutic justice in the recovery of the user and chemical dependent seeks to safeguard this, its fundamental rights guaranteed by the Federal Constitution, referring to human rights, in article 4 Inc. II and to the rights and guarantees Article 5 Parag. first of the same diploma. Noting that the World Health Organization has already acknowledged the chemical dependence is a disease, the use of the program defended here finds subsidies in article 196 of the Federal Constitution, which recognizes that health is a right of all and a duty of the state. In this work, indirect observation was used, through bibliographical materials, field research directly with promoter of the district of São Jose dos Campos Dr. Fabio Rodrigues Franco Lima, noting that the therapy applied jointly with criminal justice, which stems from the use of drugs, it is quite satisfactory, because it maintains the punitive character, with health treatment, and at the same time promotes through the meetings behavioral reflections, to analyze the evil practices that caused both society and oneself.
