O uso das redes sociais e das "fake news" nos crimes contra a honra : alcance e efetividade legislativa

Abstract

Resumo: A proposta deste trabalho é lançar luz à temática dos crimes contra a honra praticados nos meios digitais e redes sociais. Tendo por base o fenômeno das Fake News e da rápida expansão dos mecanismos de trocas de informações e conteúdos no ambiente digital, faz-se necessária uma análise das ferramentas utilizadas pelo legislador para coibir esse tipo de prática criminosa, assim como da sua efetividade legislativa e o seu potencial para atingir tal feito. É notória a dificuldade em se tentar legislar sobre um ambiente tão mutável como a Internet, que altera sua dinâmica constantemente e extrapola os limites territoriais historicamente delimitados, causando situações de difícil abordagem no campo legal e requerendo do legislador uma postura proativa e abrangente da situação para que se possa desenvolver soluções eficientes para as problemáticas que aqui se apresentam. Dito isto, também realizaremos uma identificação na legislação atual dos dispositivos que tratam do crime contra a honra e lançaremos um olhar sobre seus pontos de atuação sobre o ambiente virtual, percebendo sua efetividade ou limitação no que tange aos crimes dessa natureza praticados nesse ambiente específico.

Abstract: The proposal of this paper is to shed light on the theme of Crimes against honor practiced in digital media and social networks. Based on the phenomenon of Fake News and the rapid expansion of the mechanisms of information exchange and content in the digital environment, it is necessary to analyze the tools used by the legislator to curb this type of criminal practice, as well as the Its legislative effectiveness and its potential to achieve such achievement. It is notorious the difficulty in trying to legislate on an environment as changeable as the Internet, which alters its dynamics constantly and extrapolates the historically delimited territorial boundaries, causing situations of difficult approach in the legal field and Requesting from the legislator a proactive and comprehensive stance on the situation so that efficient solutions can be developed for the problems that are present here. That said, we will also make an identification in the current legislation of the devices dealing with the crime against honor and we will launch a look at their points of action on the virtual environment, realizing its effectiveness or limitation in relation to crimes Of this nature practiced in this specific environment.
