Prevenção de acidentes maiores

Abstract

Resumo: A ocorrência dos acidentes maiores de Flixborough, Bhopal, Cidade do México e Seveso apresentaram milhares de mortes de trabalhadores e comunidade externa, consideráveis perdas patrimoniais e contaminações ambientais. Estes acidentes alertaram as autoridades mundiais para tomada de providências, como a elaboração da Diretiva Seveso, em 1.982 pela Comunidade Européia, que foi o primeiro ato para prevenção de acidentes maiores. Após algumas revisões, foi consolidado a Diretiva Seveso II em 1.996. Além da Comunidade Européia, o EUA publicou, em 1.992, através da OSHA, o Process Safety Management of Highly Hazardous Chemicals - PSM, no âmbito da segurança do trabalho. Já o Brasil, promulgou a Convenção 174 da Organização Internacional do Trabalho e a Recomendação 181 sobre a Prevenção de Acidentes Industriais Maiores, através do Decreto 4.085, de 15 de janeiro de 2002. Alguns importantes artigos deste decreto ainda não foram implantados, havendo falhas, principalmente, no desempenho do papel da autoridade-competente, impossibilitando que o empregador consiga praticar o requisito legal. Ao final desta monografia, o empregador poderá adotar uma sistemática de prevenção de acidentes maiores, adotando os requisitos do PSM, que mesmo sendo uma legislação internacional possui profunda relação com os artigos do Decreto 4.085/02 e as normas regulamentadoras da Portaria 3214 de 08 de junho de 1.978.

Abstract: The occurrence of bigger accidents, like in Flixborough, Bhopal, México City and Seveso represented thousands of workers and external communities casualties, considerable property losses and environmental pollution. These accidents allerted worldwide authorities to take actions, like the preparation of the Seveso Directive, in 1982, by the European Community, which was the first act to prevent bigger accidents. After some revisions, the Seveso Directive II, was consolidated in 1996. Beside European Community, USA issued, in 1992, through OSHA, the Process Safety Management of Highly Hazardous Chemicals - PSM, in the extent of occupational safety. By the other side, Brazil has issued the Convention 174, of the Labor International Organization and the Recommendation 181 about the Prevention of Bigger Accidents, through the Decree 4085, of January 15th, 2002. Some important articles of this Decree were not implemented yet, existing failures, mainly, in the role performed by the competent authority, thus making impossible for the employer to put into practice this legal requirement. At the end of this monograph, the employer can adopt a bigger accidents prevention system, applying PSM requirements, which in spite of being an international regulation keeps a deep relationship with the articles of Decree 4085/02 and the Regulatory Standards of Decree 3214, of June 8th, 1978.
