A paternidade socioafetiva : efeitos jurídicos na prestação alimentar e na herança.

Abstract

Resumo: Com as mudanças sofridas no âmbito político, econômico e social, a família foi afetada, e a família patriarcal, e matrimonial retratada no Código Civil de 1916, foi aos poucos se distanciando da realidade. Com o advento da Constituição Federal de 1988, houve uma grande mudança nos conceitos de direito de família, pois ela inseriu no ordenamento jurídico novos princípios norteadores, entre eles o princípio da igualdade da filiação, princípio da dignidade humana, e princípio da afetividade. Com estes princípios, foram introduzidos no ordenamento jurídico grandes mudanças que refletiram diretamente nas relações familiares, e criaram uma nova espécie de paternidade, que é fruto da relação de afeto entre as pessoas. Este novo tipo de paternidade é objeto de análise do presente trabalho. O presente trabalho visa abordar os aspectos mais relevantes da paternidade socioafetiva, para isso será necessário explanar sobre os conceitos de família, analisando os aspectos do Código Civil de 2016 e de 2002, e principalmente da Constituição Federal de 1988 em relação ao tema. Será aprofundado o conceito de filiação, e suas formas de reconhecimento. Serão analisados também, os efeitos desta paternidade na prestação alimentar, e também na herança. Além disso, será de grande importância a utilização de grandes doutrinadores brasileiros, bem como a análise de decisões judiciais que completam o entendimento dos Tribunais sobre esta nova espécie de paternidade

Abstract: With the changes in the political, economic and social realm, the family was affected, and the patriarchal and marital family portrayed in the Civil Code of 1916 gradually distanced itself from reality. With the advent of the Federal Constitution of 1988, there was a great change in the concepts of family law, because it inserted in the legal order new guiding principles, among them the principle of equality of affiliation, principle of human dignity, and principle of affection. With these principles, major changes were introduced into the legal system that reflected directly on family relationships, and created a new kind of paternity, which is the result of the relationship of affection between people. This new type of paternity is the object of analysis of the present work. This paper aims to address the most relevant aspects of socio-affective paternity, for this it will be necessary to explain about the concepts of family, analyzing the aspects of the Civil Code of 2016 and 2002, and especially the Federal Constitution of 1988 in relation to the theme. The concept of affiliation and its forms of recognition will be further explored. The effects of this paternity on food provision and inheritance will also be analyzed. In addition, it will be of great importance the use of great Brazilian indoctrinators, as well as the analysis of judicial decisions that complete the understanding of the Courts about this new kind of paternity.
