Feminicídio : igualdade e desigualdade de proteção

Abstract

Resumo: Este trabalho tem como objetivo analisar o feminicídio no sistema penal brasileiro como circunstância qualificadora, bem como a pesquisa do próprio termo, especificando a questão do significado das palavras feminicídio e femicídio. É por esse motivo também que surgiu a estima em elaborar este trabalho, visto que o assunto é um tanto recente para a sociedade. Além de que, o assunto me chamou muito atenção pelo desconforto a respeito de como o papel da mulher é colocada em uma sociedade tradicionalmente patriarcal e machista acaba por induzirem direção na sua morte justamente por ser mulher. Para isso, a partir de algumas opiniões feministas, será efetuado um estudo do tramite da Lei nº 13.104/2015, das problematizações referentes à criminologia e aos feminismos. O feminicídio, a morte de mulheres pelo fato de serem mulheres, é assunto que ainda está sendo descoberto pelo poder judiciário e, além do mais, pelos cidadãos brasileiros que o desconhecia como um crime diferente do homicídio, mais nem menos, por esse apresentar um crime de discriminação e de ódio na circunstancia da violência de gênero. Com esta pesquisa, intencionamos a questionar as diferenças entre as palavras feminicídio e femicídio.

Abstract: This work aims to analyze feminicide in the Brazilian penal system as a qualifying circumstance, as well as the analysis of the term, differentiating the issue of semantics from the words feminicide and femicide. It is also, for this reason, that arose interest in producing this work, since the subject is relatively new to society. In addition, the theme drew attention to the concern about how the role of women in a historically patriarchal and sexist society has a direct influence on her death precisely because she is a woman. For this, from some feminist theories, the analysis of the process of Law n.13.104 / 2015, of the problematizations regarding criminology and feminisms. Femicide, the death of women because they are women, is an issue that is still being discovered by the judiciary and, even more so, by the Brazilian population who did not know it as a crime other than homicide, precisely because it presents a crime of discrimination and of hate in the context of gender violence. This study, we intend to question the differences between the words femicide and femicide as well as why our ordering has chosen one of them to compose the amendment in the Penal Code.
