Pensão militar e seus reflexos no âmbito da seguridade social

Abstract

Resumo: Vivemos um momento de ebulição política e econômica neste ano de 2019, momento de reformas estruturais importantes e necessárias para o país devido ao desequilíbrio orçamentário do Estado Brasileiro. Para equalizar as contas, o Governo Federal apresentou ao Congresso Nacional um Projeto de Lei de reforma da previdência, a Proposta de Emenda à Constituição nº 6/2019. Intitulada de "Nova Previdência", se aprovada, implantará profundas mudanças na previdência dos trabalhadores civis, tanto do setor público como do privado. Todas as classes de trabalhadores serão afetadas com estas mudanças, inclusive os militares das Forças Armadas, que possuem regime próprio de previdência e, neste momento, não foram incluídos na proposta, mas que contribuirão com o esforço para se atingir o equilíbrio fiscal do governo através do Projeto de Lei nº 1645/2019. Dito isto, início este estudo que buscará apresentar um breve histórico acerca do sistema de previdência a que os integrantes das Forças Armadas estão submetidos, desde a criação do montepio no período do Império até os dias de hoje. Para o perfeito entendimento da matéria, faz-se necessária uma breve introdução sobre os fatores históricos basilares do instituto previdenciário dos militares, da gênese do ofício militar e das suas especificidades. Também será objeto de análise neste trabalho o Sistema de Proteção Social dos Militares das Forças Armadas – SPSMFA e, por derradeiro, o instituto da Pensão Militar, incluindo o benefício da pensão para as filhas órfãs de militares, extinto em 2001 por força da Medida Provisória 2.125-10 para aqueles que incorporam às fileiras das Forças Armadas mas que ainda pesa nas contas públicas por força do direito adquirido. O objetivo principal do tema abordado é apresentar o impacto econômico da pensão militar nas contas públicas da Seguridade Social.

Abstract: We are experiencing a moment of political and economic turmoil this year of 2019, a moment of important and necessary structural reforms for the country due to the budgetary imbalance of the Brazilian State. To equalize the accounts, the Federal Government presented to the National Congress a Social Security Reform Bill, Proposed Amendment to Constitution No. 6/2019. Entitled "New Welfare", if approved, it will make profound changes in the welfare of civil workers in both the public and private sectors. All classes of workers will be affected by these changes, including the military of the Armed Forces, which have their own social security scheme and are not currently included in the proposal but will contribute to the ffort to achieve the government's fiscal balance through Bill No. 1645/2019. That said, I begin this study that will seek to present a brief history of the welfare system to which members of the Armed Forces are subjected, since the creation of montepio in the Empire period to the present day. For a perfect understanding of the subject, it is necessary a brief introduction on the basic historical factors of the military welfare institute, the genesis of the military profession and its specificities. It will also be analyzed in this work the Armed Forces Military Social Protection System - SPSMFA and, finally, the Military Pension Institute, including the benefit of the pension for the orphaned daughters of the military, extinguished in 2001 by the Provisional Measure. 2.125-10 for those who join the ranks of the Armed Forces but still weigh on the public accounts by virtue of acquired law. The main objective of this theme is to present the economic impact of the military pension in the social security public accounts.
