Comérciários : um estudo sobre percepção de direitos trabalhistas e suas violações

Abstract

Resumo: Considerando-se a importância do trabalho para a definição social do homem, assim como para seu desenvolvimento, e partindo-se do pressuposto de que na esfera trabalhista os direitos dos comerciários muitas vezes não são atendidos, nesta pesquisa problematizou-se: quem são os comerciários e como eles percebem seus direitos e as violações vivenciadas? Para responder a esse questionamento foi estabelecido, como objetivo geral da pesquisa, compreender as possíveis causas das violações aos direitos trabalhistas dos comerciários no contexto das mudanças ocorridas no mundo do trabalho. Os objetivos específicos foram definidos como: 1) identificar quais violações a direitos são frequentemente apontadas pelos comerciários; e, 2) apreender as experiências e trajetórias de comerciários e a percepção que têm sobre direitos trabalhistas e as violações por eles sofridas, bem como os motivos atribuídos por eles às referidas violações. A pesquisa foi dividida em duas fases. Na primeira foi realizado um levantamento de caráter documental para identificar características sociodemográficas e violações aos direitos trabalhistas de uma população específica: comerciários atuantes em uma cidade da Região Metropolitana do Vale do Paraíba e Litoral Norte. Os dados do levantamento foram tratados com a utilização de uma ferramenta estatística e, a partir dos resultados encontrados, na segunda fase foram realizadas entrevistas fundamentadas na Metodologia da História Oral e com utilização do método marxiano. A partir dos dados coletados e da análise com fundamento interdisciplinar (Direito, História, Filosofia, Sociologia e Economia) e em autores como Souto Maior, Hobsbawm, Marx, Engels, Lukács, Heloani, Antunes, Lessa, entre outros, conseguiu-se traçar um perfil do comerciário e constatou-se que ele não tem consciência de classe/categoria, bem como a sua percepção de direitos e violações é elementar. Entende-se que os resultados poderão subsidiar novos estudos e implementação de práticas que visem diminuir as violações dos direitos trabalhistas que são concernentes a essa categoria de trabalhadores.

Abstract: Considering the importance of the work for the social definition of man, as well as for his development, and assuming that in the labor sphere the rights of the traders are often not met, in this research it was problematized: who are and how do they perceive their rights and violations experienced? To answer this question, it was established, as a general objective of the research, to understand the possible causes of violations of the labor rights of traders in the context of changes in the world of work. The specific objectives were defined as: 1) identifying which rights violations are frequently pointed out by the traders; and 2) to understand the experiences and trajectories of traders and their perception of labor rights and the violations they suffer, as well as the reasons attributed by them to the above mentioned violations. The research was divided into two phases. In the first, a documentary survey was carried out to identify sociodemographic characteristics and violations of the labor rights of a specific population: traders working in a city in the Metropolitan Region of the Paraíba Valley and North Coast. The data of the survey were treated with the use of a statistical tool and, from the results found, in the second phase interviews were conducted based on Oral History Methodology and using the Marxian method. Based on the data collected and the analysis with interdisciplinary basis (Law, History, Philosophy, Sociology and Economics) and authors such as Souto Maior, Hobsbawm, Marx, Engels, Lukács, Heloani, Antunes, Lessa, among others, a profile of the trader and found that he is not aware of class / category, as well as his perception of rights and violations is elementary. It is understood that the results may support new studies and implementation of practices aimed at reducing violations of labor rights that are related to this category of workers.
