Direitos fundamentais, liberdade de expressão e "Hate Speech"

Abstract

Resumo: O constitucionalismo é um movimento de imensurável importância na história da humanidade, do qual se originaram diversos dos direitos que protegem a sociedade em amplas e variadas áreas.Apesar de ser um instituto recente tipificado principalmente no rol de direitos fundamentais do ordenamento jurídico brasileiro, seu cerne tem origem na dignidade da pessoa humana, conceito existente até mesmo nas sociedades datadas antes de Cristo, que ao longo dos séculos e milênios transformaram-se no mais importante instituto do direito no mundo todo, buscando garantir o mínimo existencial a todo ser humano. Um dos direitos salvaguardados pela Constituição Federal é a Liberdade de Expressão, que sofreu muito em diversos países até tornar-se efetiva, como no Brasil e, períodos imperialistas e ditatoriais, haja vista de que, há países que sofrem até a atualidade e lutam pelo mesmo. Mesmo com a devida importância, a liberdade de expressão deve ser limitada, de modo que preserve os demais direitos fundamentais e infraconstitucionais, não admitindo que, ao seu exercício, seja cerceado ou ofendido qualquer ser humano.

Abstract: Constitcuionalism is a movement of immensurable importance in the history oif mankind, wich gave rise to several of the rights that protects society in wide and varied áreas. Despite being a recent institute typified mainly in the listo f fundamental rights of the brazilial legal system, its core hás it origin in the dignity of the human person, a concept that existes even in sicetds dated before Christ, wich over the centuries and millenial have become the most importante institute of Law worldwide, seeking to guarantee the minum existenxial to every human being. One of the rights safeguarded by the Federal Constitution is Freedom of Expression, wich suffered a lot in several counters until it became effective, as in Brazil and, imperilist and dictatiorial periods, considering that, there are countries that suffer until today and fight by the same. Even with due importance, freedom of expression must be limited, so as to preserve other as to preserve other fundamental and infraconstitucional rights, not admitting that any human being is restricted or offended when exercising it
