Mulheres no cárcere : a maternidade e a gestação nas penitenciárias femininas

Abstract

Resumo: O presente estudo traz uma análise do sistema carcerário feminino, em especial as dificuldades encontradas em torno da gestação e maternidade nos estabelecimentos prisionais. Descreve a trajetória histórica da criação do sistema prisional no Brasil, desde o período colonial até os dias atuais. Contextualiza a dificuldade da evolução do sistema prisional para um sistema especial para as mulheres e a criação das primeiras penitenciarias femininas. Demonstra como o sistema carcerário foi moldado para os homens, e todas as dificuldades encontradas por essas mulheres ao serem inseridas nesse meio, onde são esquecidas suas necessidades em razão de sua distinção biológica. O principal objetivo da pesquisa é mostrar o descaso do Estado com as especificidades femininas dentro dos presídios, o descuido com a higiene, com a saúde, com a alimentação e principalmente pelo vínculo de mãe e filho que vivem dentro das penitenciarias. Analisam-se as leis já existentes para preservar os direitos das encarceradas e de seus filhos, e de como esses direitos infelizmente não são respeitados na vida real.

Abstract: The present study presents an analysis of the female prison system, especially the difficulties encountered around pregnancy and motherhood in prisons. It describes the historical trajectory of the creation of the prison system in Brazil, from the colonial period to the present day. It contextualizes the difficulty of the evolution of the prison system to a special system for women and the creation of the first female penitentiary. It demonstrates how the prison system was shaped for men, and all the difficulties encountered by these women when they were inserted in this environment, where their needs are forgotten due to their biological distinction. The main objective of the research is to show the neglect of the State with the feminine specificities within prisons, the carelessness with hygiene, with health, with food and especially by the bond of mother and child living within prisons. We analyze existing laws to preserve the rights of inmates and their children, and how these rights are unfortunately not respected in real life.
