Idoso : responsabilidade político-social e jurídica

Abstract

Resumo: A presente monografia buscou apresentar quais são os direitos dos idosos previstos pelo ordenamento jurídico brasileiro, dando enfoque aos Princípios norteadores instituídos pela Constituição Federal de 1988 e pela Lei nº 10.741/2003, conhecida como Estatuto do Idoso. O estudo demonstra que os filhos tem o dever de cuidar pelos pais, não apenas de maneira financeira, mas levando em conta o Principio da Dignidade da Pessoa Humana e o Principio da Afetividade uma vez que os idosos merecem afeto, carinho e zelo. Busca apresentar as consequências jurídicas que os responsáveis pelos idosos podem vir a sofrer caso não cumpram com suas responsabilidades. Assim como apresenta a inovação do instituto família desde os primórdios, destacando a importância de cada ente familiar para a criação de um ambiente estável e concreto. Para realização deste trabalho foi usado o entendimento de doutrinadores, autores e entendedores do direito, assim como o entendimento de diversos Tribunais sobre o assunto em questão. Outrossim, essa monografia possui relevante papel na sociedade por tratar de um assunto pouco abordado na atualidade, desta forma, podendo contribuir para que o abandono afetivo não tome grandes proporções e os direitos dos idosos sejam assegurados.

Abstract: This monograph sought to present the rights of the elderly provided for by the Brazilian legal system, focusing on the guiding Principles instituted by the Federal Constitution of 1988 and by Law No. 10.741 / 2003, known as the Elderly Statute. The study demonstrates that children have a duty to care for their parents, not only financially, but taking into account the Principle of Dignity of the Human Person and the Principle of Affection since the elderly deserve affection, care and zeal. It seeks to present the legal consequences that those responsible for the elderly may suffer if they do not fulfill their responsibilities. Just as it presents the innovation of the family institute since the beginning, highlighting the importance of each family member for the creation of a stable and concrete environment. To carry out this work, the understanding of legal professors, authors and experts was used, as well as the understanding of several Courts on the subject in question. Furthermore, this monograph has an important role in society because it deals with a subject little addressed today, thus, it can contribute so that the emotional abandonment does not take great proportions and the rights of the elderly are guaranteed.
