Família multiespécie : a evolução familiar e seus reflexos na sociedade

Abstract

Resumo: O trabalho apresentado buscou demonstrar os reflexos da família multiespécie em nossa sociedade, fundamentada pelo amor recíproco e convivência contínua entre o ser humano e o animal. Todavia, lamentavelmente a legislação pátria é precária no que se refere aos animais, quer sejam, eles domésticos ou não, sendo tratados na legislação apenas como coisa, retirando deles a capacidade de serem sujeitos de direitos. Demonstramos através do direito comparado a existência precedente de legislação estrangeira sobre o tema, com aplicação direta aos animais e por vezes regulamentando a convivência entre humano e animal. Por fim, demonstramos os resultados almejados através da legislação regulamentadora, com a evolução do núcleo familiar, a sociedade anseia pela normatização de diretos na guarda e cuidados com os pets. Através da pesquisa realizada, identificamos que a morosidade do Poder Legislativo em regulamentar a matéria, acarretou uma necessidade de o Poder Judiciário agir ativamente decidindo casos pontuais através da aplicação da analogia. O Trabalho de Graduação foi confeccionado em tópicos como meio de demonstrar adequadamente do que se trata o assunto abordado, a ausência de regulamentação legal é o motivo pelo qual se impõe a necessidade de uma efetiva regulamentação e consequentemente os efeitos desta regulamentação em nosso ordenamento jurídico.

Abstract: The work presented sought to demonstrate the importance of the multispecies family in our society, based on mutual love and continuous coexistence between human and non-human animals, to form a family and extract from it the fruits of their deepest yearnings. Unfortunately, the national legislation is still precarious about animals, whether domesticated or not, while it treats them in the legislation as a thing, depriving them of their capacity to be subjects of law. We demonstrate through comparative law the previous existence of foreign legislation on the subject, with direct application to animals and sometimes regulating the coexistence between human and animal. Finally, we demonstrate the desired results through the legal regulation the society claims, with its direct effects on the custody and care of pets. Through the research carried out, we identified that the slowness of the Legislative Power in regulating the matter, led to a need for the Judiciary Power to act actively, deciding specific cases through the application of analogy. The Undergraduate Work was made in topics as a means to adequately demonstrate what the subject is about, the absence of legal regulation is the reason why the need for an effective regulation is imposed and, consequently, the effects of this regulation in our legal system.
