Do casamento, da união estável e do namoro : consequências patrimoniais e jurídicas

Abstract

Resumo: O presente trabalho de conclusão de curso visa apresentar uma análise dos históricos, avanços e peculiaridades do tema do direito das famílias, com foco no casamento, união estável e no namoro, apresentando e abordandos as consequências patrimôniais e jurídicas de tais relações. O mesmo se baseia nas relações afetivas desenvolvidas na sociedade e nos efeitos jurídicos e patrimonais que as mesmas irão gerar. Tal pesquisa se caracteriza como sendo uma pesquisa bibliográfica, tendo como base para a sua formação doutrinas, legislações e textos que versam sobre o assunto presentes em meios físicos e digitais. As relaçãoes e as entidades familiares se caracterizam como sendo a base para a sociedade e as mesmas importam para o mundo jurídico, onde as mesmas possuem uma seara própria para análises e regras, sendo o Direito das famílias. É de extrema importância que as distinções existentes entre os institutos bases para a presente pesquisa sejam lecionadas, pois os mesmos se diferenciam e consequentemente produzem efeitos juridicos e patrimôniais distintos. Diante disso, tal trabalho buscou apresentar informações relevantes acerca dos institutos do Casamento, da União Estável e do Namoro, buscando apresentar os seus atributos, suas conceituações jurídicos e bem como os seus efeitos produzidos, com a finalidade de apresentar uma análise crítica direcionando o aprendizado da distinção de tais institutos jurídicos pertencentes ao Direito das Famílias, vertente do Direito Civil.

Abstract: The present work of conclusion of course aims to present an analysis of the history, advances and peculiarities of the theme of family law, focusing on marriage, stable union and dating, presenting and addressing the patrimonial and legal consequences of such relationships. The same is based on the affective relationships developed in society and the legal and patrimonial effects that they will generate. Such research is characterized as being a bibliographic research, having as basis for its formation doctrines, legislation and texts that deal with the subject present in physical and digital media. Family relationships and entities are characterized as being the basis for society and they matter for the legal world, where they have their own area for analysis and rules, being the family law. It is extremely important that the distinctions existing between the basic institutes for this research are taught, as they differ and consequently produce different legal and patrimonial effects. Therefore, this work sought to present relevant information about the institutes of Marriage, Stable Union and Dating, seeking to present their attributes, their legal concepts and their effects produced, in order to present a critical analysis directing learning the distinction of such legal institutes belonging to Family Law, part of Civil Law.
