Alienação parental à luz da justiça brasileira

Abstract

Resumo: O presente trabalho de conclusão de curso relata sobre a família: conceito, prática do poder familiar, evolução e as suspensões, perdas e extinção deste poder. Discorre sobre o Direito de Família, e enfatiza a efetividade dentro da relação conjugal. A dissolução de tal relação no âmbito familiar, sendo fundamental estabelecer a guarda e a regulamentação de visitas a quem não exercer o poder familiar. Tal estudo identifica os princípios constitucionais de proteção à criança e ao adolescente e discorre sobre a legislação, Lei nº 12.318/2010 e nº 13.431/2017, identificando a Alienação Parental, sua Síndrome e alienador, reconhecendo como forma de violência psicológica os atos praticados, assegurando-se o direito de pleitear medidas protetivas, sendo desenvolvimento do processo de separações e divórcios conturbados, alterando a formação do menor, rompendo laços afetivos e deixando sequelas. Ao final demonstra os procedimentos processuais dentro da tutela, curatela, pois bem demonstra a importância da família e do respeito mútuo entre os cônjuges em garantia dos filhos.

Abstract: This monograph reports on family: its conception, the family power practice, its improvement and disqualifications, reductions and cancellation of this power. This monograph tells us about family rights and emphasizes their efficacy in marital relationships. Also, it reports on a break-up marital relationship in a family environment which is essential to establish the custody and regulations of visits to the ones that don't have the family power. Moreover, this study identifies the constitutional principles for the protection of children and teenagers and discusses the legislative: Law number: 12.318 / 2010 and number: 13.431 / 2017, identifying the Parental Alienation and its syndrome recognizing it as psychological abuse, all the acts done. Further, it provides the right to request protective measures which is the development of break-up and troubled divorces processes that change kids raising and consequently it breaks binding ties and it traumatizes kids. Finally, it shows the procedural procedures within the guardianship and trusteeship, and demonstrates the importance of the family and the mutual respect between the spouses in guaranteeing the children.
