Da curatela : inovações ao instituto advindas da Lei 13.146/2015

Abstract

Resumo: O presente trabalho monográfico visa fazer uma análise crítica e ponderar sobre as inovações no instituto da curatela trazidas pelo novel Estatuto da Pessoa com Deficiência, Lei 13.146/15 no ordenamento jurídico brasileiro, observando a questão específica da curatela e de sua modificação, bem como analisar as outras alterações derivadas do Estatuto e que também afetam o instituto da curatela. Para tanto, foi necessária uma explanação ampla em relação a evolução histórica da proteção jurídica da pessoa com deficiência. Em seguida, a pesquisa passou a analisar os reflexos do Estatuto da Pessoa com Deficiência na curatela, observar a mudança da capacidade civil e as novas perspectivas da curatela, bem como a contradição de alguns artigos do Estatuto com o Novo Código de Processo Civil. A pesquisa abordou entendimentos doutrinários e jurisprudenciais para saber quais foram essas inovações e se foram realmente positivas ou negativas no tratamento jurídico e humanístico dado às pessoas com deficiência, e como está sendo aplicada a nova regra no caso concreto. Encerra-se o estudo, concluindo que as modificações foram muito positivas, uma vez que possibilitaram a autodeterminação das pessoas com deficiência na busca por mais inclusão social e cidadania.

Abstract: This monographic work aims to make a critical analysis and consider the innovations in the institute of trusteeship brought by the novel Statute of Persons with Disabilities, Law 13.146/15 in the Brazilian legal system, observing the specific issue of trusteeship and its modification, as well as analyzing the other changes arising from the Statute and which also affect the institute of trusteeship. Therefore, a broad explanation was needed regarding the historical evolution of the legal protection of people with disabilities. Then, the research began to analyze the effects of the Statute of Persons with Disabilities in the trusteeship, observe the change in civil capacity and the new perspectives of trusteeship, as well as the contradiction of some articles of the Statute with the New Code of Civil Procedure. The research addressed doctrinal and jurisprudential understandings to find out what these innovations were and whether they were really positive or negative in the legal and humanistic treatment given to people with disabilities, and how the new rule is being applied in the specific case. The study ends, concluding that the changes were very positive, as they enabled the self-determination of people with disabilities in the search for more social inclusion and citizenship.
