Direito ao esquecimento na esfera criminal : uma análise do conflito entre os direitos de liberdade de expressão e acesso à informação

Abstract

Resumo: O presente estudo tem como objetivo central analisar o direito ao esquecimento na esfera criminal, considerando o modo como vem sendo aplicado, bem como suas implicações e consequências ao cidadão egresso e às vítimas, diante da exposição de suas privacidades nos atuais meios de comunicação. Por este motivo, neste trabalho, será exposto a origem e evolução do direito ao esquecimento no Brasil, as teorias existentes sobre o tema, os casos concretos, a definição e conceituação dos direitos de expressão e acesso à informação, além de analisar os recentes julgados, com a finalidade de compreender como os Tribunais vêm se posicionando acerca do tema e a viabilidade de soluções apontadas, organizando-as efetivamente. A metodologia utilizada consistiu em pesquisa bibliográfica e análise jurisprudencial.

Abstract: The present study aims to analyze the right to forgetfulness in the criminal sphere, considering the way it has been applied, as well as its implications and consequences to the outgoing citizen and victims, given the exposure of their privacy in the current media. For this reason, in this work, the origin and evolution of the right to forgetfulness in Brazil, the existing theories on the subject, concrete cases, the definition and conceptualization of the rights of expression and access to information will be exposed, in addition to analyzing the recent judgments, in order to understand how the Courts have been positioning themselves on the subject and the feasibility of solutions pointed out by organising them effectively. The methodology used consisted of bibliographic research and jurisprudential analysis.
