Direito à moradia : panorama constitucional e a segregação social

Abstract

Resumo: O objetivo deste trabalho é identificar as dificuldades que se interpõem para a efetivação da moradia das pessoas em situação de vulnerabilidade social, partindo-se da análise da legislação vigente. Busca compreender a construção do direito fundamental e social à moradia e o seu conteúdo, bem como, compreender sua aplicação dentro do sistema jurídico implementado pela Constituição Federal de 1988, que visa apresentar o direito à moradia para além do direito à propriedade. Foi utilizada a análise bibliográfica como metodologia, apresentando-se a doutrina constitucional nacional, especializada em direitos fundamentais e sociais. Ademais, foi utilizada a legislação vigente que discorre sobre as moradias em zona de risco e/ou precárias. Concluiu-se que por se tratar de um direito social cuja prestação configura um dever do Estado Social, é necessário que o Estado apresente alternativas para efetivação deste Direito, tais como políticas públicas e Plano Diretor.

Abstract: The objective of this work is to identify the difficulties that arise for the realization of the housing of people in a situation of social vulnerability, starting from the analysis of the current legislation. It seeks to understand the construction of the fundamental and social right to housing and its content, as well as to understand its application within the legal system implemented by the Federal Constitution of 1988, aims to present the Right to Housing in addition to the right to property. Bibliographic analysis was used as a methodology, presenting the national constitutional doctrine, specialized in fundamental and social rights. In addition, the current legislation that addresses housing in risk and / or precarious areas was used. It was concluded that because it is a social right whose provision constitutes a duty of the Social State, it is necessary for the State to present alternatives for the realization of this Right, such as public policies and the Master Plan.
