A atuação do tribunal superior eleitoral no combate ao fenômeno das fake news e a garantia ao direito de liberdade de expressão

Abstract

Resumo: "Se está na internet, é verdade!". Apesar de ainda ser um pensamento muito difundido, tal conceito não pode ser empregado para definir os fatos e notícias que percorrem diariamente nas redes sociais, principalmente em períodos de campanha eleitoral. O presente trabalho visa demonstrar qual a atuação do Tribunal Superior Eleitoral no combate à divulgação em massa de fake news durante o pleito eleitoral de 2018, seus reflexos no pleito de 2020 e quais medidas vêm tomando para coibir sua disseminação e educar os eleitores sobre o compartilhamento excessivo de informação. É notório que, com a globalização e modernidade da sociedade atual, a internet exerce grande influência no poder de decisão da população, refletindo também no voto do eleitor quando, ao se deparar com notícias falsas veiculadas à imagem de um determinado candidato, têm seu poder de decisão viciado, comprometendo a lisura do processo eleitoral. Com isso, buscou-se aprofundar na definição e características de identificação das fake news, qual a sua influência no processo eleitoral, através das redes sociais, e quais os riscos da sua disseminação aos eleitores e ao devido processo eleitoral. Após, pretende-se demonstrar quais as estratégias e medidas adotadas pelo órgão da Justiça Eleitoral a fim de coibir sua extrema divulgação, ao tempo que protege e resguarda o princípio de Liberdade de Expressão do cidadão. Faz-se necessário o questionamento uma vez que tal princípio é garantia constitucional do Estado Democrático de Direito e elemento essencial para a democracia de um país. Por fim, faz-se uma breve análise de decisões monocráticas proferidas pelo Tribunal Superior Eleitoral durante o pleito de 2018, demonstrando qual a sua efetiva participação no combate às fake news e na garantia de um processo eleitoral com candidaturas legítimas e atuação transparente.

Abstract: "If it's on the internet, it's true!". Despite still being a widespread thought, this concept cannot be used to define the facts and news that travel daily on social networks, especially during periods of electoral campaign. This paper aims to demonstrate the role of the Superior Electoral Court in combating the mass dissemination of fake news during the 2018 election, its effects on the 2020 election and what measures have been taken to curb its dissemination and educate voters about sharing excessive information. It is notorious that, with the globalization and modernity of today's society, the internet exerts a great influence on the population's decision-making power, also reflecting on the voter's vote when, when faced with false news conveyed in the image of a particular candidate, they have its power decision-making, compromising the fairness of the electoral process. With this, we sought to deepen the definition and identification characteristics of fake news, what is its influence on the electoral process, through social networks, and what are the risks of its dissemination to voters and to the due electoral process. Afterwards, it is intended to demonstrate which strategies and measures have been adopted by the Electoral Justice body in order to curb its extreme dissemination, while protecting and safeguarding the principle of Freedom of Expression of the citizen. Questioning is necessary since this principle is a constitutional guarantee of the Democratic Rule of Law and an essential element for a country's democracy. Finally, there is a brief analysis of monocratic decisions rendered by the Superior Electoral Court during the 2018 election, demonstrating its effective participation in the fight against fake news and in guaranteeing an electoral process with legitimate candidacies and transparent performance.
