Abstract

Resumo: A posse e o porte de armas da população civil do Brasil é tema que vem sendo discutido desde os primórdios da instituição do Estado. Não obstante, se faz necessário esmiuçar o universo histórico das leis que permeiam a aquisição de arma de fogo pelos brasileiros, bem como os decretos executivos que regulamentaram os pontos que necessitavam ser normatizados. O objetivo deste material é entender e examinar os importantes pontos que geram discussão acerca dos procedimentos necessários para aquisição de uma arma de fogo pelo cidadão brasileiro dentro dos limites estabelecidos pela Lei e pela Constituição, bem como explicar o trâmite necessário para o desembaraço desde a expectativa de compra de um armamento, se desdobrando no porte até a sua derradeira renovação. Exaustivas pesquisas em Leis, jurisprudências, doutrinas, livros, teses e artigos levaram a elaboração deste trabalho, bem como a investigação na realidade dos fatos mostrados através de materiais disponíveis em sites governamentais que envolvem o tema. Seus desdobramentos são consequências das conclusões obtidas através da leitura e interpretação dos dados observados que mostraram uma notável evolução acerca da desburocratização dos procedimentos para a aquisição de um armamento, desde a elaboração da Lei 10.826/2003 até os atuais Decretos do Executivo Federal.

Abstract: The possession and carrying of weapons by the civilian population in Brazil is a topic that has been discussed since the beginning of the institution of the State. Nevertheless, it is necessary to scrutinize the historical universe of the laws that permeate the acquisition of firearms by Brazilians, as well as the executive decrees that regulated the points that needed to be regulated. The purpose of this material is to understand and examine the important points that generate discussion about the necessary procedures for the acquisition of a firearm by the Brazilian citizen within the limits established by the Law and the Constitution, as well as to explain the necessary procedure for clearance from the expectation from the purchase of a weapon, unfolding in bearing until its ultimate renewal. Exhaustive research in Law, jurisprudence, doctrines, books, theses and articles led to the elaboration to this work, as well as the investigation into the reality of the facts shown through material available on government websites that involve the subject. Its consequences are consequences of the conclusions obtained through the reading and interpretation of the observed data, which showed a remarkable evolution regarding the reduction of bureaucracy in the produces for the acquisition of weapons, from the drafting of Law 10.826/2003 to the current Federal Executive Decrees.
