Direito à saúde e o ativismo judicial

Abstract

Resumo: O ativismo judicial vem se tornando um protagonista desde a Constituição Cidadã de 1988, embora alvo de bastante controvérsia, uma vez que se prioriza as vontades dos tribunais superiores ao invés do procedimento legislativo e executivo. Esse cenário, portanto, apresenta aspectos positivos e negativos ante aos anseios e pleitos da sociedade brasileira. O presente trabalho de graduação objetiva analisar criticamente, historicamente e conceitualmente o instituto da saúde como direito fundamental e prestacional, abarcando a função do Estado como garantidor através de políticas públicas efetivas, com seus devidos entraves financeiros. Traça-se, ainda, um panorama estrutural do Sistema Único de Saúde como organismo ativo e promovente do direito à saúde em território brasileiro. Por fim, permeia-se o entendimento jurisprudencial diversificado e recente com a incidência do ativismo judicial, em seus aspectos essenciais e definidores, como solução remediadora da inércia dos poderes Executivo e Legislativo, com breves comentários de como a atividade positiva judiciária incide no contexto pandêmico do coronavírus em território brasileiro.

Abstract: Judicial activism has become a protagonist since the Citizen Constitution of 1988, although the target of much controversy, since it prioritizes the wishes of higher courts instead of the legislative and executive procedure. This scenario, therefore, presents both positive and negative aspects in the face of the desires and demands of Brazilian society. The present graduation work aims to analyze critically, historically and conceptually, the institute of health as a fundamental right, covering the function of the State as guarantor through effective public policies, with its due financial obstacles. It also traces a structural panorama of the Unified Health System as an active organism and promoter of the right to health in Brazilian territory. Finally, it permeates the diverse and recent jurisprudential understanding with the incidence of judicial activism, in its essential and defining aspects, as a remedial solution to the inertia of the Executive and Legislative branches, with brief comments of how the positive judicial activity affects the pandemic context of the coronavirus in Brazilian territory.
