O direito ao aborto decorrente do crime de estupro tendo o homem como vítima

Abstract

Resumo: O estudo tem a finalidade de tratar, sem pretensão de ser exaustivo, sobre o direito ao aborto decorrente do crime de estupro tendo o homem como vítima, observando-se a nova redação do artigo 213 do Código Penal, a qual tornou o estupro um crime comum, sendo viável, na atualidade, a mulher figurar como sujeito ativo do delito. Frisa-se que diante da prática do crime na condição que se propõe no trabalho, há possibilidade de resultar a gravidez da infratora; perante esta viabilidade irá analisar a possibilidade do homem vítima optar pelo aborto em razão do súpero princípio da igualdade, além de analisar a possibilidade da relativização do direito à paternidade. Em suma, no presente busca extrapolar as fronteiras do Código Penal, bem como refletir em outra esfera do direito. Não menos importante, expõe oposições no tocante ao enunciado da tese, problematizando o tema. Feitas as devidas pontuações, o trabalho propõe saída restauradora e apropriada ao caso, verificando os critérios morais e legais que envolvem o fato.

Abstract: The study aims to address, without claiming to be exhaustive, the right to abortion arising from the crime of rape with the man as a victim, observing the new wording of article 213 of the Penal Code, which made rape a crime common, being viable, nowadays, for the woman to appear as the active subject of the crime. It is noteworthy that, given the practice of crime in the condition proposed at work, there is a possibility of pregnancy of the offender; in view of this feasibility, it will analyze the possibility of the male victim opting for abortion due to the supreme principle of equality, in addition to analyzing the possibility of relativizing the right to paternity. In short, at present it seeks to extrapolate the boundaries of the Penal Code, as well as reflect on another sphere of law. No less important, it exposes oppositions regarding the thesis statement, problematizing the theme. After the appropriate scores, the work proposes a restorative and appropriate solution to the case, verifying the moral and legal criteria that involve the fact.
