Reprodução humana assistida

Abstract

Resumo: Este trabalho consiste na pesquisa acerca da Reprodução Humana Assistida, as técnicas mais comuns utilizadas e o que diz o ordenamento jurídico a respeito dos procedimentos médicos e suas consequências envolvendo o tema. A presente pesquisa tem como ponto inicial a vida, abordando o desenvolvimento do embrião até a fase fetal. Passadas as fases iniciais de desenvolvimento biológico humano, o foco segue no tema central da pesquisa, a reprodução humana assistida, a abordagem histórica, quais as técnicas mais utilizadas e as leis que regulamentam o assunto. Foi levantada a questão dos embriões excedentários e como isto ainda continua divergindo entre os doutrinadores, juristas e profissionais da área médica. O trabalho descreve um pouco sobre a bioética e o biodireito, matérias importantes que visam à proteção da vida humana frente ao progresso da biotecnologia e alerta para o perigo da banalização da vida. Por fim são apresentadas possíveis soluções para a questão dos embriões excedentários como a adoção de embriões e o uso de células tronco embrionárias para pesquisas científicas e terapias médicas. O objetivo deste trabalho consiste em demonstrar que as novas tecnologias na área da saúde, como a reprodução humana assistida, avançam rapidamente e trazem consequências das quais o Direito deve apresentar soluções contundentes e proteger o bem maior, a vida. A pesquisa bibliográfica sobre o tema foi o método de pesquisa utilizado neste trabalho.

Abstract: This work consists of research on Assisted Human Reproduction, the most commontechniques used and what the legal system says about medical procedures and their consequences involving the theme. The present research has as initial point life, addressing the development of the embryo up to the fetal phase. After the early stages of human biological development, the focus is on the central theme of research, assisted humanreproduction, the historical approach, which techniques are most used and the laws regulating the subject. The issue of surplus embryos has been raised and how this still diverging among doctrinators, jurists and medical professionals. The paper describes a little about bioethics and biolaw, important matters aimed at the protection of human life in the face of the progress of biotechnology and alerts to the danger of trivialization of life. Finally, possible solutions to the issue of surplus embryos such as embryo adoption and embryos use for scientific research and medical therapies are presented. The objective of this work is to demonstrate that new technologies in the area of health, such as assisted human reproduction, advance rapidly and bring consequences of which the law must present hard-hitting solutions and protect the greater good, life. The bibliographic research on the subject was the research method used in this work.
