Salário maternidade para o segurado do gênero masculino

Abstract

Resumo: O presente trabalho tem como cerne analisar as novas possibilidades trazidas pela lei em relação a concessão do benefício previdenciário salário maternidade ao segurado do sexo masculino. Para analisar tais possibilidades será feita uma análise do instituto que é responsável pelo benéfico em questão, qual seja a previdência social e esse instituto está inserido, na seguridade social. Será inquirido também o termo "maternidade" trazendo o que tal vocábulo representava antigamente e o que representa hoje, sendo feita uma breve passagem histórica na evolução do papel da mulher na sociedade bem como a evolução de seu papel dentro no núcleo familiar. Posteriormente será analisado o benéfico salário maternidade em si, quem faz jus e seus requisitos para concessão, adentrando também na possibilidade da percepção do beneficio pelo gênero masculino, podendo ainda a concessão ser feita em virtude de adoção ou em decorrência de óbito.

Abstract: The present work has as its core to analyze the new possibilities brought by the law in relation to the granting of the maternity social security salary benefit to the male insured. To analyze these possibilities, an analysis will be made of the institute that is responsible for the benefit in question, which is social security, and that institute is inserted in social security. The term "maternity" will also be asked, bringing what that word used to represent and what it represents today, making a brief historical passage on the evolution of the role of women in society as well as the evolution of their role within the family nucleus. Subsequently, the beneficial maternity salary itself will be analyzed, who is entitled and its requirements for concession, also entering the possibility of the perception of the benefit by the male gender, and the concession may also be made due to adoption or due to death.
