O Estatuto da pessoa com deficiência e sua aplicabilidade no âmbito educacional

Abstract

Resumo: A presente pesquisa visa analisar os direitos da pessoa com deficiência no âmbito educacional, determinando se estes têm sido observados na prática e indicando possíveis soluções para os problemas identificados. Para contextualizar a percepção de deficiência através do tempo, inicialmente será apresentado o contexto histórico, e qual era o tratamento da pessoa com deficiência em cada era e sociedade. Após este primeiro momento serão expostos os tratados internacionais e declarações humanitárias que incentivaram a criação de mecanismos sociais, como leis especiais, para garantir o princípio da igualdade a todas as pessoas, incluindo os deficientes, minoria que sempre foi deixada à margem. Os princípios e direitos da pessoa com deficiência, muitos previstos no Estatuto da Pessoa com Deficiência, também serão explorados, para que se possa fazer um paralelo entre a expectativa social e o que de fato ocorre no cotidiano. Por fim, tendo realizado o embasamento teórico da questão, entraremos no cerne da pesquisa, investigando o cenário educacional brasileiro e qual o tratamento recebido pelas pessoas com deficiência nesta seara. Esta pesquisa objetiva responder se tem sido efetiva a inclusão e se têm atendido seus objetivos, baseando-se na literatura sobre o tema e analisando um estudo de caso.

Abstract: This research aims to analyze the rights of people with disabilities in the educational field, determining whether these have been observed in practice and indicating possible solutions to the problems identified. To contextualize the perception of disability over time, initially the historical context will be presented, and what was the treatment of people with disabilities in each era and society. After this first moment, international treaties and humanitarian declarations that encouraged the creation of social mechanisms, such as special laws, to guarantee the principle of equality for all people, including the disabled, will be exposed, a minority that has always been left out. The principles and rights of persons with disabilities, many of which are provided for in the Statute for Persons with Disabilities, will also be explored, so that a parallel can be drawn between social expectation and what actually occurs in everyday life. Finally, having carried out the theoretical basis of the question, we will enter the heart of the research, investigating the Brazilian educational scenario and the treatment received by people with disabilities in this field. This research aims to answer whether inclusion has been effective and whether its objectives have been met, based on the literature on the subject and analyzing a case study.
