Proteção constitucional à liberdade religiosa

Abstract

Resumo: O presente trabalho tem como objetivo fazer uma análise acerca da liberdade religiosa através da análise de doutrinas, constituições e jurisprudências. Para que haja um entendimento sólido e aprofundado, iniciará abordando os direitos e garantias fundamentais desde os seus primórdios, acompanhando sua evolução com o caminhar da história, analisando e situando as três dimensões de direitos fundamentais. Conceituará a liberdade de expressão e seus desdobramentos, bem como da liberdade de pensamento e da liberdade religiosa. O texto prosseguirá demonstrando as sete constituições brasileiras, situando o contexto histórico em que foram criadas, a forma como abordaram os direitos e garantias fundamentais, a forma de Estado e a forma de governo, o modelo de separação de poderes adotado, e por fim a forma como cada uma das constituições abordava a liberdade religiosa. Em sua última parte o trabalho abordará o conceito de Estado laico interagindo com a liberdade religiosa, demonstrará como a Constituição lida com a proteção dos locais de culto e suas liturgias e encerrará fazendo uma análise de algumas jurisprudências que demonstram como os tribunais têm ponderado situações onde há conflito entre o direito à Liberdade Religiosa e outros direitos.

Abstract: This paper aims to analyze religious freedom through the analysis of doctrines, constitutions and jurisprudence. In order for there to be a solid and in-depth understanding, it will start by addressing fundamental rights and guarantees since its beginnings, following its evolution as history progresses, analyzing and situating the three dimensions of fundamental rights. It will conceptualize freedom of expression and its consequences, as well as freedom of thought and religious freedom. The text will continue to demonstrate the seven Brazilian constitutions, situating the historical context in which they were created, the way in which they approached fundamental rights and guarantees, the form of State and the form of government, the model of separation of powers adopted, and finally the how each constitution addressed religious freedom. In its last part, the work will address the concept of secular state interacting with religious freedom, demonstrate how the Constitution deals with the protection of places of worship and their liturgies, and will end by analyzing some of the jurisprudences that demonstrate how the courts have considered situations where there is a conflict between the right to religious freedom and other rights.
