Alienação parental

Abstract

Resumo: O presente estudo refere-se à problemática verificada no Direito de Família, decorrente da dissolução conjugal e disputa de guarda, resultando na Alienação Parental, causando a nomeada Síndrome da Alienação Parental. Sendo indispensável à análise, com o propósito de controlar a prática, bem como proteger o bem-estar dos menores e, até mesmo, impossibilitar consequências psicológicas decorrentes da problemática. A partir da pesquisa desenvolvida, observa-se que as crianças e os adolescentes, vítimas da Síndrome da Alienação Parental têm os desenvolvimentos psíquico-sociológico afetado e prejudicado, contestando o que indica o ordenamento jurídico, que estima pela convivência familiar saudável. Bem como, o Direito impôs normas que indicam sanções para coibir a prática pelo alienador, ocorrência primordial à proteção da criança e do adolescente. Conclui-se que a família se forma pelos vínculos de afeto, fortalecido pelos membros, e mesmo após a dissolução conjugal, os cônjuges precisam manter uma relação de contato saudável em prol da saúde mental de seus filhos, para poupá-los de sofrimentos e sequelas futura.

Abstract: The present study refers to the problematic verified in Family Law, due to the conjugal dissolution and custody dispute, resulting in the of Parental Alienation, causing the socalled Parental Alienation Syndrome. Being indispensable for the analysis, with the purpose of controlling the practice, as well as protecting the well being of the minors and, even, impossible psychological consequences arising from the problematic. From the research developed, it is observed that the children and adolescents, victims of the Parental Alienation Syndrome have the psychic-sociological developments affected and impaired, challenging what the legal order indicates, which estimates for healthy family life. As well as, the Law imposed norms that indicate sanctions to curb the practice by the alienator, primordial occurrence to the protection of the child and the adolescent. It is concluded that the family is formed by the bonds of affection, strengthened by the members, and even after the conjugal dissolution, the spouses must maintain a healthy contact relation for the mental health of their children, to spare them of sufferings and sequels future.
