O indiciamento perante prova obtida por reconhecimento fotográfico

Abstract

Resumo: presente monografia, em sua natureza jurídica voltada ao Direito Processual Penal, objetiva pormenorizar cada um dos passos que levam ao indiciamento de um indivíduo por meio do reconhecimento fotográfico, trazendo informações quanto ao tempo em que deve ser realizado o indiciamento e em qual contexto processual, aclarando ser este a qualquer tempo desde que durante o inquérito policial. Dadas tais informações, importa esclarecer o quanto importa da fase pré-processual onde se realiza o indiciamento, resumindo seu início e seu fim. Posteriormente passa-se a discussão da classificação do meio de prova ora em comento no momento inquisitorial, qual seja, o reconhecimento por meio de fotografia. Não pode-se olvidar da descrição do meio probatório em si, iniciando-se pelo reconhecimento pessoal do qual ele decorre, chegando a modalidade realizada por fotografias. Por fim, expõe-se as principais falhas intrínscecas ao reconhecimento pessoal e, em especial, àquele realizado por meio de fotografia, quais sejam, a desatenção as formalidades dispostas em legislação processual penal e a ocorrência das falsas memórias.

Abstract: This monograph, in its legal nature focused on Criminal Procedural Law, aims to detail each of the steps that lead to the indictment of an individual through photographic recognition, providing information about the time in which the indictment must be carried out and in which procedural context, clarifying to be this at any time since during the police investigation. Given such information, it is important to clarify the importance of the pre-procedural phase where the indictment takes place, summarizing its beginning and end. Subsequently, the discussion of the classification of the evidence now under discussion at the inquisitorial moment is discussed, that is, recognition through photography. One cannot forget about the description of the evidence itself, starting with the personal recognition from which it derives, reaching the modality carried out by photographs. Finally, it exposes the main intrinsic flaws to personal recognition and, in particular, to that carried out through photography, namely, the inattention to the formalities provided in criminal procedural legislation and the occurrence of false memories.
