A aplicação da legislação na defesa de terceiros em casos de violência doméstica familiar

Abstract

Resumo: Trata-se de revisão bibliográfica acerca da relação e da aplicabilidade da legítima defesa de terceiros nos casos de violência doméstica e familiar. Sabe-se que essa forma de violência ocorre sempre em cenários onde o Estado não pode intervir no momento exato em que a agressão está ocorrendo, de forma que nem sempre a própria vítima tem condição de assim se defender. Com base nisso, o objetivo geral deste estudo é demonstrar a possibilidade de um terceiro intervir na defesa da vítima de violência doméstica e familiar, utilizando-se da legítima defesa de terceiro, na forma do art. 25 do Código Penal. Para tanto, realizou-se uma pesquisa bibliográfica em bases de dados eletrônicos e livros jurídicos. Conclui-se que, por ser a legítima defesa um direito individual e o texto legal prever a possibilidade de ser utilizada em prol de terceiros, é plenamente cabível esta tese defensiva nos cenários de violência doméstica e familiar, considerando o fato de que se trata de uma das mais graves violações de direitos humanos, e o fato de que ocorre em situações onde o Estado não pode agir de forma imediata para cessar a injusta agressão sofrida pela vítima.

Abstract: This is a literature review about the relationship and applicability of self-defense of third parties in cases of domestic and family violence. It is known that this form of violence always occurs in scenarios where the State cannot intervene at the exact moment when the aggression is taking place, so that the victim himself is not always able to defend himself in this way. Based on this, the general objective of this study is to demonstrate the possibility of a third party to intervene in the defense of the victim of domestic and family violence, using the third party's self-defense, in the form of art. 25 of the Penal Code. Therefore, bibliographic research was carried out in electronic databases and legal books. It is concluded that, as self-defense is an individual right and the legal text provides for the possibility of being used on behalf of third parties, this defensive thesis is fully applicable in the scenarios of domestic and family violence, considering the fact that it is a question of one of the most serious violations of human rights, and the fact that it occurs in situations where the State cannot act immediately to stop the unjust aggression suffered by the victim.
