O crime de "hate speech" nas redes sociais e os limites da liberdade de expressão

Abstract

Resumo: O hate speech, ou discurso de ódio, revela-se, cada vez mais, como sendo um desafio para o Direito e à busca a justiça, vez que se confronta com os limites da liberdade de expressão. Ainda que se trate de um evento nada recente, é fato que a ascensão da internet e, principalmente do uso das redes sociais, faz com que a proliferação do discurso de ódio e suas consequentes problemáticas se tornem mais alarmantes. Pensamentos discriminatórios e repressivos ultrapassam demasiadamente a esfera particular de indivíduos que acreditam estar apenas exercendo seu direito de se expressar e, assim, atingem, de maneira grave, outros sujeitos – aqui, vítimas. Por outro prisma, a liberdade de manifestação é garantia inalienável, basilar e constitucional, prevista no artigo 5º da Carta Magna Brasileira, não podendo, nos tempos atuais, depois de grandes oposições, ser desconsiderada. Neste cenário, o presente Trabalho de Conclusão de Curso tem como escopo analisar o fenômeno do discurso de ódio especificamente no âmbito das redes sociais, bem como a sua relação com o princípio da liberdade de expressão e outros preceitos fundamentais. Atém-se a examinar tais conceitos, a dinâmica dos conflitos, as disposições legais e as possíveis soluções para a questionável, através dos meios principais de ponderação e dialética. Por fim, tem como base diversos estudos documentais, bibliográficos e legislativos, além de outros recursos de pesquisa direta e indireta.

Abstract: Hate speech is increasingly becoming a challenge to Law and to the search for justice, since it clashes with the limits of freedom of speech. Although this is not a recent event, it is a fact that the rise of the Internet, and especially the use of social networks, makes the proliferation of hate speech and its consequent problems more alarming. Discriminatory and repressive thoughts exceed too much the private sphere of individuals who believe they are only exercising their right to express themselves and, thus, seriously affect other subjects - here, the victims. On the other hand, freedom of expression is an inalienable, fundamental, constitutional guarantee, provided for in Article 5 of the Brazilian Constitution, and cannot, in current times, after great opposition, be disregarded. In this scenario, the present End of Course Work has the purpose of analyzing the phenomenon of hate speech specifically in the scope of social networks, as well as its relation with the principle of freedom of speech and other fundamental precepts. It strives to examine such concepts, the dynamics of conflicts, legal provisions, and possible solutions to the questionable one, through the main means of weighting and dialectics. Finally, it is based on several documental, bibliographic and legislative studies, as well as other direct and indirect research resources.
