Planejamento municipal : a deficiência das peças de planejamento e suas consequências sociais e jurídicas

Abstract

Resumo: Este estudo visa analisar o papel dos municípios na federação brasileira e o histórico do planejamento junto a municipalidade brasileira. Planejar é uma obrigação constitucional imposta aos municípios que tem o papel fundamental de otimizar a utilização dos recursos públicos de modo a mitigar os problemas da população local. É fato que os municípios, em especial os de pequeno porte, sofrem com a escassez de recursos e para tanto precisam estabelecer prioridades através de suas peças orçamentárias (Plano Plurianual, Lei de Diretrizes Orçamentárias e Lei Orçamentária Anual) para garantir a boa prestação dos serviços públicos. Para tanto, foi selecionado o município de São Bento do Sapucaí, situado no interior do Estado de São Paulo e com pouco mais de dez mil habitantes, para que a partir dos dados coletados sobre o município, possa ser feita uma análise mais aprofundada sobre as deficiências e os impactos do planejamento municipal. Dessa forma, pretende-se abordar elementos históricos dos municípios e do planejamento, bem como as deficiências de planejamento comumente encontradas nos municípios de pequeno porte, que trazem dificuldades na gestão orçamentária para a realização de programas, metas, ações e objetivos das peças orçamentárias, os quais, por sua vez, não trazem indicadores factíveis, o que faz com que a execução das peças de planejamento seja, a princípio, inexequíveis sobre o ponto de vista prático e objetivam apenas o cumprimento de meras formalidades legais. Para tanto, realizou-se uma pesquisa bibliográfica em livros, artigos, legislações e documentos estatísticos, visando tratar qualitativamente os dados encontrados, pelo método dialético. A título de conclusão, constatou-se que de fato o planejamento se mostra deficiente na maioria dos municípios, sendo que, por um lado, os municípios de pequeno porte apresentam certa vantagem para identificação dos problemas locais diante da proximidade da gestão com a sociedade, mas por outro lado, encontram dificuldades com o baixo efetivo de pessoal, falta de capacitação dos servidores e falta de ferramentas tecnológicas, relacionadas com a escassez de recursos.

In this way, it is intended to address historical elements of municipalities and planning, as well as the planning deficiencies commonly found in small municipalities, which bring difficulties in budget management for the realization of programs, goals, actions and objectives of the budget pieces, which, in turn, do not bring feasible indicators, which makes the execution of the planning pieces, in principle, unfeasible from a practical point of view and aim only at the fulfillment of mere legal formalities. Therefore, a bibliographic research was carried out in books, articles, legislation and statistical documents, aiming to qualitatively treat the data found, by the dialectical method. As a conclusion, it was found that in fact planning is deficient in most municipalities, and, on the one hand, small municipalities have a certain advantage in identifying local problems in view of the proximity of management to society, but on the other hand, they face difficulties with the low number of staff, lack of training of servers and lack of technological tools, related to the scarcity of resources.
