A desjudicialização com foco no inventário e na partilha extrajudiciais

Abstract

Resumo: O presente trabalho aborda sobre o movimento da desjudicialização, com foco no inventário e na partilha extrajudiciais, viabilizando o acesso à justiça de forma mais célere. Diante do crescente aumento de demanda junto ao Poder Judiciário, também vêm crescendo as buscas por meios alternativos de solução de conflitos e diminuição das demandas pela via judicial. Diante deste contexto, muitos procedimentos extrajudiciais vêm se desenvolvendo. A Lei nº 11.441/2007 permitiu a realização de processos de inventário, partilha, divórcio e separação perante os Tabelionatos de Notas, trazendo mais celeridade e acessibilidade, bem como, menos burocracia, facilitando o acesso à justiça. Por fim, a desjudicialização ainda auxilia na diminuição de demandas junto ao Poder Judiciário, propiciando ao judiciário que atue em causas mais direcionadas, conferindo mais celeridade e efetividade ao acesso à justiça para a população, seja pela via extrajudicial ou judicial, principalmente com relação ao inventário e a partilha extrajudiciais.

Abstract: The present work deals with the movement of dejudicialization, focusing on the extrajudicial inventory and sharing, enabling faster access to justice. Faced with the increasing demand with the Judiciary, the search for alternative means of conflict resolution and reduction of demands through the judicial route has also been growing. In this context, many extrajudicial procedures have been developed. Law No. 11,441/2007 allowed the carrying out of probate, sharing, divorce and separation proceedings before Notary Publics, bringing more speed and accessibility, as well as less bureaucracy, easier access to justice. Finally, the dejudicialization also helps to reduce demands with the Judiciary, allowing the judiciary to act in more targeted causes, giving more speed and effectiveness to the access to justice for the population, whether through extrajudicial or judicial means, especially with regard to the extrajudicial inventory and sharing.
