Porte e posse de arma de fogo dos crimes no exercício do direito

Abstract

Resumo: Porte de arma no Brasil, que acompanhou a evolução mundial na produção de armamento onde surgiu a necessidade de regulamentação através da Lei no 10.826, de 22 de dezembro de 2003, que por sua vez fora regulamentada através do Decreto nº 5.123, de 1º de julho de 2004, sendo alterado através do DECRETO Nº 9.685, DE 15 DE JANEIRO DE 2019, e ainda com de crimes de porte e posse através do código penal. Por meio da regulamentação e possibilidade de porte por membros das forças policiais e agentes vinculados à segurança pública e patrimonial, surge a competência da Polícia Federal por meio do Sistema Nacional De Armas – SINARM e do Comando do Exército com uso do Sistema De Gerenciamento Militar De Armas - SIGMA. Através deste controle, foi possibilitado ao policial, guarda civil, guarda municipal e cidadão comum o uso de armamento de porte permitido, com o devido controle de sua concessão, porte e posse, manuseio e manutenção de todo armamento lícito no país.

Abstract: Possession of a weapon in Brazil, which followed the world evolution in the production of weapons, where the need for regulation arose through Law No. of 2004, being amended through DECREE No. 9.685, OF JANUARY 15, 2019, and also with crimes of possession and possession through the penal code. Through the regulation and the possibility of carrying by members of the police forces and agents linked to public and property security, the competence of the Federal Police arises through the National Weapons System - SINARM and the Army Command using the Military Management System of Weapons - SIGMA. Through this control, it was possible for the police, civil guard, municipal guard and ordinary citizens to use weapons of permitted carrying, with due control of their concession, carrying and possession, handling and maintenance of all legal weapons in the country.
