Doença ocupacional : responsabilidade do empregador pelas sequelas do COVID19 em trabalhadores do setor da saúde

Abstract

Resumo: O trabalho apresentado buscou demonstrar as consequências jurídicas da pandemia do COVID-19, no âmbito trabalhista em nossa sociedade, com base no direito trabalhista e no direito previdenciário. Demonstrando os avanços legislativos executivos e judiciais na matéria, como forma de proteção ao trabalhador. Demonstramos através do direito comparado a existência precedente de legislação estrangeira, com aplicação direta aos trabalhadores e por vezes regulamentando os impactos no ambiente de trabalho e fora dele. Por fim, demonstramos os reflexos na vida do trabalhador através da legislação regulamentadora, com a evolução do Direito do Trabalho, e também, reflexos no Direito Civil e Previdenciário, ambos, como forma de amparar o trabalhador neste momento crucial de sua vida laboral. O Trabalho de Graduação foi feito em tópicos como forma de demonstrar adequadamente o que o assunto abordou, a atualização do entendimento judiciário, bem como a modernização jurídica que ocorreu de forma abrupta, é a razão pela qual a necessidade de regulamentação efetiva e consequentemente os efeitos da este regulamento no nosso ordenamento jurídico.

Abstract: The work presented sought to demonstrate the importance of the multispecies family in our society, based on mutual love and continuous coexistence between human and non-human animals, to form a family and extract from it the fruits of their deepest yearnings. Unfortunately, the national legislation is still precarious about animals, whether domesticated or not, while it treats them in the legislation as a thing, depriving them of their capacity to be subjects of law. We demonstrate through comparative law the previous existence of foreign legislation on the subject, with direct application to animals and sometimes regulating the coexistence between human and animal. Finally, we demonstrate the desired results through the legal regulation the society claims, with its direct effects on the custody and care of pets. Through the research carried out, we identified that the slowness of the Legislative Power in regulating the matter, led to a need for the Judiciary Power to act actively, deciding specific cases through the application of analogy. The Undergraduate Work was made in topics as a means to adequately demonstrate what the subject is about, the absence of legal regulation is the reason why the need for an effective regulation is imposed and, consequently, the effects of this regulation in our legal system.
