Guarda compartilhada de animal de estimação após a dissolução consensual do vínculo conjugal

Abstract

Resumo: O presente trabalho de graduação pretende demonstrar que a mediação é a melhor forma de lidar com dissoluções conjugais, diante de famílias culturais e, a priori, famílias multiespécie. Para isso, abordar-se-á os direitos dos animais no contexto brasileiro, bem como, a relação entre humanos e bichos em diversos contextos entre eles histórico, econômico e o psicológico. Passará a ser discorrido também a natureza jurídica dos bichos diante do atual Código Civil, diante da possibilidade de ser: coisas, ou então, ente despersonalizado. Com o fim de ilustrar o assunto, a situações será analisada e comentada jurisprudência pertinente a aplicabilidade do direito de família em favor dos animais de família. Será analisado no trabalho a necessidade de haver legislação específica que contemplem famílias não previstas na constituição federal, visto que são protegidas pelo princípio da afetividade, e como será explicado no trabalho, não devem ter seus pleitos supridos por analogias que não levam em consideração o afeto e a diversidade familiar no Brasil, cujo intuito é propor uma efetiva atualização jurídica.

Abstract: The present undergraduate work intends to demonstrate that mediation is the best way to deal with marital dissolutions, in the face of cultural families and, a priori, multispecies families. For this, the rights of animals in the Brazilian context will be approached, as well as the relationship between humans and animals in different contexts, including historical, economic and psychological. The legal nature of animals will also be discussed in the face of the current Civil Code, in view of the possibility of being: things, or else, a depersonalized entity. In order to illustrate the subject, the situations will be analyzed and jurisprudence relevant to the applicability of family law in favor of family animals will be discussed. It will be analyzed in the work the need to have specific legislation that contemplate families not foreseen in the federal constitution, since they are protected by the principle of affectivity, and as will be explained in the work, they should not have their claims supplied by analogies that do not take into account the affection and family diversity in Brazil, whose purpose is to propose an effective legal update.
