O instituto da usucapião e a (i)legitimidade ativa dos herdeiros

Abstract

Resumo: O presente trabalho de graduação tem como objetivo realizar uma pesquisa sobre o instituto da usucapião, bem como analisar situações envolvendo a (i)legitimidade ativa dos herdeiros para o ajuizamento de ação de usucapião. Para tanto, foram realizadas pesquisas bibliográficas, doutrinárias e jurisprudenciais, que resultaram na elaboração de quatro capítulos. Inicialmente foi feita uma breve explanação sobre a evolução histórica do instituto. No capítulo seguinte, foram abordados todos os requisitos e as modalidades de usucapião. Na sequência, tratou-se da ação de usucapião e da problemática da legitimidade ativa dos herdeiros. Por fim, foi realizada uma análise jurisprudencial para a identificação de ocorrências ligadas à legitimidade ativa dos herdeiros em ações de usucapião e quais fundamentos relacionados a cada uma delas. A partir do referencial teórico e da discussão, foi possível verificar que é viável o ajuizamento de ação diretamente por um herdeiro, desde que este comprove a posse exclusiva sobre o imóvel, bem como os preenchimento dos requisitos da usucapião na modalidade extraordinária. Caso contrário, a legitimidade ativa será do espólio, ao qual, em caso de procedência, será declarado o domínio sobre o bem para posterior partilha em via própria.

Abstract: The present undergraduate work aims to conduct a research on the institute of the adverse possession, as well as to analyze situations involving the active legitimacy of the heirs for the judgement of action of adverse possession. To this end, bibiographical, doctrinal and jurisprudential research was carried out, which resulted in the elaboration of four chapters. Initially a brief explanation was made about the historical evolution of the institute. In the following chapter, all the requirements and modalities of adverse possession were addressed. Next, it was the action of adverse possession and the problem of the active legitimacy of the heirs. Finally, a jurisprudential analysis was performed to identify occurrences related to the active legitimacy of the heirs in adverse possession actions and what grounds related to each of them. From the theoretical framework and the discussion, it was possible to verify that it is feasible to judge the action directly by an heir, provided that the owner proves the exclusive possession over the property, as well as the fulfillment of the requirements of the adverse possession in the extraordinary modality. Otherwise, the active legitimacy will be of the estate, to which, in the event of origin, the domain over the good for further sharing on its own means will be declared.
