Possibilidade de cumulação dos adicionais de insalubridade e periculosidade

Abstract

Resumo: A pesquisa visa analisar a possibilidade da cumulação dos adicionais de insalubridade e periculosidade para fins remuneratórios dos trabalhadores. O tema se delimita em discutir porque os adicionais devem ser cumulados, tendo em vista que no dia 26/09/2019 a Subseção I Especializada em Dissídios Individuais (SDI-1) do Tribunal Superior do Trabalho vedou o recebimento cumulativo dos adicionais de insalubridade e de periculosidade. Para isso será explanado acerca do meio ambiente de trabalho, que está correlacionado com a saúde dos empregados, sendo que a saúde do trabalhador ganhou destaque apenas com a revolução industrial e no Brasil somente com o aumento das indústrias. Ademais, como o trabalho é voltado aos adicionais, estes serão examinados de maneira individual para que seja possível compreender do que cada um se trata, visando assim explicar acerca da possibilidade da cumulação desses adicionais para remunerar os empregados, tendo em vista que são institutos distintos e que não se confundem.

Abstract: The research aims to analyze the possibility of cumulating unhealthy and hazardous work premiums for workers' compensation purposes. The topic is limited in discussing why the additionals must be cumulated, considering that on 09/26/2019 the Subsection I Specialized in Individual Agreements (SDI1 of the Superior Labor Court prohibited the cumulative receipt of unhealthy and of dangerousness. For this, it will be explained about the work environment, which is correlated with the health of employees, and the health of the worker gained prominence only with the industrial revolution and in Brazil only with the increase of industries. In addition, as the work is aimed at additionals, these will be examined individually so that it is possible to understand what each one is about, in order to explain about the possibility of cumulating these additionals to remunerate employees, given that they are different institutes and that they are not confused.
