Guarda compartilhada : reflexões

Abstract

Resumo: Este estudo apresenta uma modalidade de guarda garantida pelo Direito de Família Brasileiro, a guarda compartilhada. A partir disso, é possível perceber que no ordenamento jurídico brasileiro existe uma divergência de entendimento sobre o tema. Diante disso, esta pesquisa justifica-se, para fim de estudo, abrir o tema em si e comentar suas reflexões. Os objetivos desta pesquisa é apresentar a origem no poder familiar no Direito brasileiro, depois passaremos para o conceito de guarda e suas respectivas modalidades e no fim será adentrado especificamente na modalidade da guarda compartilhada. A metodologia utilizada foi a pesquisa doutrinária, na qual será especificado o entendimento jurisprudencial majoritário, as vantagens e desvantagens e o envolvimento dos filhos nesta espécie de guarda. O resultado alcançado deste trabalho foi perceber que a guarda compartilhada deve ser aplicada em casos específicos, pois demanda de análise de cada caso concretamente, pois é exigido uma renúncia de ambas as parte e principalmente do filho, pois fica vulnerável à possíveis desavenças entre os pais, sendo necessário a intervenção de profissionais sociais para que a aplicação seja eficaz. No mais, a modalidade possui grandes vantagens aos filhos, pois têm o direito de serem criados e educados por ambos os pais, garantindo assim, um crescimento saudável e produtivo à eles.

Abstract: This study presents a mode of custody guaranteed by the Brazilian Family Law: The shared custody. From this, it is possible to perceive that in the Brazilian legal system there is a divergence of understanding on the subject. There fore, this research is justified, for study purposes, to open the theme itself and comment its reflections. The objectives of this research is to present the origin of family power in Brazilian law, then we will move on to the concept of guard and its modalities and at the end it will be specifically entered in the shared custody modality. The methodology used was the doctrinal research, which will specify the majority jurisprudential understanding, the advantages and disadvantages and the involvement of the children in this kind of guard. The obtained result of this work was to realize that shared custody should be applied in specific cases, demanding a new analysis on every different concrete case, there way be a renunciation of both part and especially of the child and there also way be disagreements between parents, and the intervention of social workers is necessary for effective application. In addition to that, the modality brings great advantages for the children, since they have the right to be raised and educated by both parents, thus guaranteeing a healthy and productive growth to them.
