Judicialização da saúde : o impacto da interferência do judiciáio nos recursos orçamentários e a disparidade social no acesso a saúde

Abstract

Resumo: Nos últimos anos, tem se observado uma crescente onda de judicialização da saúde no Brasil. A judicialização da saúde é um tema relevante e controverso, pois envolve o direito fundamental à saúde e o dever do Estado em garantir a sua proteção. Notase a preocupação dos entes federados na crescente demanda judicial no que tange ao direito da saúde, tendo em vista as implicações e restrições orçamentárias que elas podem gerar para atender e garantir o direito a saúde da coletividade em detrimento do direito individual. No presente trabalho, abordar-se-á evolução dos direitos sociais, com foco no direito à saúde no Brasil, além de tratar do Sistema Único de Saúde (SUS) e seus princípios norteadores. Além disso, serão discutidos os princípios constitucionais limitantes que balizam o alcance efetivo do direito à saúde, como a reserva do possível, o mínimo existencial, a igualdade e a separação dos poderes. Por fim, a monografia aborda os principais julgados e a visão da jurisprudência sobre o tema, bem como os impactos sociais e orçamentários decorrentes dessa prática cada vez mais frequente no país.

Abstract: In recent years, there has been a growing wave of judicialization of health in Brazil. The judicialization of health is a relevant and controversial issue, as it involves the fundamental right to health and the State's duty to guarantee its protection. The concern of the federated entities is noted in the growing judicial demand regarding the right to health, in view of the implications and budgetary restrictions that they can generate to meet and guarantee the right to health of the community to the detriment of individual rights. In the present work, the evolution of social rights will be approached, focusing on the right to health in Brazil, in addition to dealing with the Unified Health System (SUS) and its guiding principles. In addition, the limiting constitutional principles that guide the effective reach of the right to health will be discussed, such as the reserve of the possible, the existential minimum, equality, and separation of powers. Finally, the work addresses the main judgments and the view of jurisprudence on the subject and the social and budgetary impacts resulting from this increasingly frequent practice in the country.
