Abandono afetivo inverso e o direito à sucessão : deserdação e a indignidade sucessória

Abstract

Resumo: O presente trabalho visa abordar a temática da possível exclusão sucessória do herdeiro necessário por abandono afetivo inverso, tendo em vista que na atualidade a família é baseada no afeto. A problemática está pautada no fato de ocorrer o abandono afetivo inverso em muitas famílias e não haver respaldo na lei, pois o artigo é taxativo. Assim, nota-se a importância da atualização da taxatividade dos artigos de deserdação ou indignidade, inserindo um novo inciso. Nesse sentido, o que se pode concluir com base nas pesquisas realizadas durante o desenvolvimento do presente trabalho é que tal assunto é tão pertinente que constam Projetos de Lei com objetivo de se tornar uma hipótese de exclusão.

Abstract: The present work aims to address the theme of the possible succession exclusion of the necessary heir due to reverse affective abandonment, considering that currently the family is based on affection. The problem is based on the fact that the reverse affective abandonment occurs in many families and there is no support in the law, as the article is exhaustive. Thus, it is noted the importance of updating the exhaustiveness of articles of disinheritance or indignity, inserting a new item. In this sense, what can be concluded based on the research carried out during the development of the present work is that this subject is so relevant that there are Law Projects with the objective of becoming a hypothesis of exclusion.
